Legal insurance attending in English?

Hi Forum,

We recently contacted our legal insurance CAP to ask a question about temporary contracts, via email written in English. We received a very long answer in german, arguing that the language switch was in order to answer as quickly as possible.

We replied that there was no need to rush and we could wait some days if that gets us an answer in English.

After that, the lawyer replied that they can only guarantee that the legal information given is accurate if its written in german.

After complaining, the long german email became a 3 sentences long English one.

Is there any legal insurance in Switzerland that can attend expats who dont read "legal german" yet?

Thanks in advance.

Well it might help if you told us what kind of insurance you are trying to obtain?

Hi, as I state in the title and the post itself: legal insurance. I think it's also called legal protection insurance.

Thanks.

Re: Legal insurance attending in English?

I can't really help but I do often hear stories of "official and legal documents can only be in one of the official languages", which kind of makes sense. As much as your legal German isn't so hot I can imagine that the German speaking lawyers wouldn't know how to translate into legal English, nor may they know how to translate into layman's German :-)

I'm sure with such a level of education required for such things that there must be English speaking folk out there who can help, even if the documents themselves can't be (only) in English.

Just out of interest, what's your native language?

So if I understand you correctly then you are seeking insurance to cover your legal costs only should someone take you to court, is that right?

@st2lemans: An explanation would have been far more useful than a groan! And of course an actual contribution would have been even better.

Legal insurance is for anything that requires a lawyer, not just going to court.

Problems with neighbors/landlords, accidents, incorrect traffic citations, etc.

Most people here have it.

I think you need legal insurance to take on the problem you are having with your legal insurance.... just kidding

It's quite common that legal stuff is only in one of the national languages for the reason you were given. its why if you don't speak German the RAV insist you take and interpreter... it's your responsibility to understand the information give and if they make a mistake in the translation they can be held liable, was how it was explained to me.

Re: Legal insurance attending in English?

Ideally you need someone with a Swiss Law Degree/Masters/Bar with native German and English. Good luck with finding that!!!

Any legal text would have to be perfectly translated both literally but also in meaning - not a task to be taken lightly.

Not really, we were told by our Allianz advisor that any doubt we had at any time could be asked to the legal service, not just when wanting to sue someone.

Actually our contract states that this is possible. We can sue our own legal insurance and its covered

Sure, but our Allianz advisor said we could be attended in more than 20 languages. And what is more important, for that question we don't really need a legal text, it is almost a yes/no question which can include proper legal references at the end.

Thanks. We have all our insurances with Allianz, they just don't do legal directly and refer to CAP instead.

There is an important difference between the legal support being in English and legal contracts/interview/submissions/cases being accurately translated into English.

I know of someone who got quite severely shafted because the person supplied by their legal insurance to cover the English for the client failed to accurately translate what was said.

Re: Legal insurance attending in English?

Your issue is pretty common as a lot of companies only speak the official Swiss languages but slowly more and more companies now also speak English. There are companies that offer legal protection insurance in English though including Allianz, Generali (Fortuna) and Protekta just to name a few.
