URGENT Car Crash Help

Hello All,

On Friday, I stupidly had a car accident with myslef and a fence. No other parties involved. Only damage to my car and council fence.

At the time of the incident, the traffic patrol (not police) showed up and diverted traffic around my car. I speak zero french and my phone just died with my source of translation , where i was staying was 1km away, and as the traffic was under control and nobody else was involved, I walked back to collect my insurance and car documents and drivers license as I knew the police would probably want them, essentially trying to speed things up rather than standing on the side of the road in the cold.

Long story short, by the time I had returned to my car with documents, the vehicle had been cleared away and nobody was at the scene anymore - Swiss efficiency

I got an email from the police overnight requesting me to come on tuesday to the: Police Routière, Brigade Routière & Accidents (BRA). I said i would attend.

I sent a following email to the officer asking the location of the vehicle so my insurance could begin the process of assessment.

The officer replied saying is had been sequestered for DNA analysis. And if I do not show on tuesday an arrest warrant would be put out. The officer will only say the remaining procedure will be completed with a translator on tuesday and gives no further details.

Ok, now I am confused. I hit only a fence and damaged my car which my insurance covers. Traffic patrol were in attendance before i decided to go to collect my documents.

Looking back, yes I know i should have stayed, but after a bump I was not thinking straight at all.

It is considered an Hit and Run. Expect a hefty income based penalty an license ban for some months.

Did you tell the traffic warden about your intention before you left the scene?
Did you call the police about the accident before you left the scene?
Did you at least leave any note bheind about your intentions whay you left the scene?

In general in an accident where either people got injured or third party property was damaged and you cannot inform said third party immediately you must call the police and wait at the scene of the accident.

You are only allowed to leave the scene of an accident when no one was injured and all parties whos property was damaged were informed. This includes public property and also wild life. "Owner" of wildlife is the game warden of the hunting district.

The only thing which is strange that they did not come after you immediately, to arrested you and perform a alcohol and drug test.

Whilst you should have stayed with the vehicle, their concern is probably alcohol or drug involvement, but they are also human, tell the truth, explain why you did what you did, you may or may not get an extra fine for leaving the scene of an accident but you will be far better off coming clean.

Police had been informed, and attended, however i did not see them as I was away collecting documents/charging phone, and by the time i returned it was all cleared up and nobody was there.

I have been in touch with the officer to give my account, and to explain my actions. I have been honest with them.

PS: Considering you do not speak the language, do not even know very basic traffic law I strongly suggest to speak only with the police after you consulted an lawyer.

council fence was the protective barriers around roundabouts, or in the middle of highways.

what is likely to be the outcome of the 'meeting' tomorrow ? Any ideas?

i thought it would be filling in paperwork and supplying details.

after his email i am sh*tting bricks...

Better take someone who does speak French with you tomorrow! Depending on their view, it could be a simple thing or Fahrerflucht (hit and run) worst case. So make sure you understand properly what they ask

Depending on how forgiving they are, and up to what level they want to believe you something in between covering the damage, up to the costs of the damage, the tow-truck, storage of your car, research, huge fine and a long time without driver's license. And you might have insurance, but if the reason the car needed a tow truck was your absence then do not expect them to pay for those costs.

Also if you have been gone from the moment that nobody was there, till the moment everybody was gone again you have been gone for a way to long time and not just a few minutes. If you did not go to the police station right after you discovered your car was gone then do expect the most worse that can happen in such situation.

And as others have said, come prepared and take somebody with you if needed.

I don't want to give you a hard time, but as a teacher you will recognise that your actions were irresponsible.

This is not a good BBC series - you disappeared from the accident. There could have been casualties, and you evaded being tested for alcohol / drugs. Why you didn't carry the necessary IDs in the car is another question.

How the police got your email address without carried ID is another.

I was absent for a 1-2km walk, 30 min search for docs, 15 min earful from wife and walk back.. Yes longer than i had expected when i set off on the dazed and confused mission for documents.
Traffic patrol was on scene before i had left.

The damage, tow truck, storage and any liability of the incident is covered by my insurance . I have already checked with that.

What about the fine? I am a low income autistic behavioural therapist/teacher.

What about the fine/license loss .. ball park figure?

I know .. the email baffles me also. I assume it is somehow linked to the Critic'Air Vignet?

Yes, looking back, I know I should have stayed and would have not been dealing with this now, but I was really shaken and confused after.. anybody will vouch for the fuzzy thinking after an accident.

I knew 100% there was nobody else involved

I never carry car documents with me, and rarely a wallet on short journeys.
