Computer damage at UNI

Hi. my daughter as charging her laptop at UNIL Lausanne and someone came along looking at their phone and tripped over it and it's extremely damaged. I am not sure where to go from here and if it would be deemed his damage or hers? any advice greatly appreciated

The person who damaged it damaged it, and should be claimed against their insurance.

However the person who tripped may not have been negligent & the could have a claim against the person who left the wire they tripped over.

It all depends on the situation, if she left it on the ground or set up a tripwire, and the person walking there should not expect such, it should be deemed her own fault.

Which is why I am still fan of the MagSafe connector on my (old) MacBook...
On a more practical note:
- if the guy who tripped on the wire and totaled the laptop was negligent, he should notify his private liability insurance and get them to pay. Here the circumstances are relevant, where was the socket, where was the laptop, are laptops usually plugged in there, etc.
- possibly it is covered by your own insurance. There is some insurance on credit cards, or part of your home insurance, or part of the insurance coverage sold together with your laptop which cover accidental damages. If yes you can claim there.

Where is the negligence? The negligence was in leaving a charging cable in a place where someone could trip over it. Just lucky he did not trip and break a leg!

Negligence exists where a person fails to apply the diligence that can be expected from average person in the same situation.

The OP stated that the guy was looking at his phone and hence not looking where he was going.

Thus in my view it comes down to whether there was an expectation that charging cable might be there or not and hence whether one would need to keep one's eyes out for any obstructions. This depends on the circumstances.

If the laptop was set up in a study area in the library and plugged into the nearest socket, and the guy simply cut a corner, then I could see negligence on his part. If of course the charging cable was strung across a main corridor, then less so.

I think the cell phone zombie is at fault, if he was paying attention there would have been no problem.

On this note, can I run one over if they happen to cross in front of my car and their (pedestrian) is red ? I am thinking about installing an airhorn (one that plays Dixie) especially for this case...
