SWICA threatens to replace my student VVG policy in a week with a more expensive KVG

Hello everyone,

I am a student on a B permit and took out a student supplementary insurance package (VVG) with SWICA since I arrived last September. I submitted the application for exemption to Gesundheitdirektion Zürich also in September. The application is still being processed as of today. I have paid insurance premiums as usual in the previous months.

Since September, one SWICA officer kept asking me for the exemption form. Every time, I checked the application status and it was still being processed, and I forwarded him the status.

Today, I got an email from the same officer demanding the exemption form (which is still being processed) by next week, or otherwise it would "assume" that the application was rejected and would "need to replace" my VVG package with the more expensive compulsory package (KVG)! The officer was citing Art. 3 in the ZVB, which said

Die STUDENT CARE kann von einer Person beantragt werden, die:
– aus dem Ausland in die Schweiz einreisen will oder eingereist ist und
– sich vorübergehend in der Schweiz zum Zweck einer Aus oder Weiterbildung aufhält (wie namentlich Schüler, Studenten, Praktikanten, Stagiaires) und
– vor Vollendung des 45. Altersjahres steht und
– keiner obligatorischen Versicherungspflicht untersteht, sich davon befreit hat oder ein Gesuch um Befreiung einreicht.

Bei einer rechtskräftig gewordenen Ablehnung des Gesuchs um Befreiung von der Versicherungspflicht gemäss KVG gilt der Versicherungsantrag per Antragstellung als nichtig.

which only says the policy will be nullified when the application is rejected. No mention about when it is pending or about the conversion to KVG! I also haven't reached 45, so I don't think I miss any requirement in Art. 3. I don't believe they are allowed to do this.

What would be the right course of actions here?

- Should I send a registered letter this week to perhaps the Head of Client Services objecting this?

As far as I know a VVG package can only be supplementary to an accepted base insurance coverage. You can not get an exemption for a VVG coverage alone.

The KVG base coverage is quite comprehensive and you must show that your alternative coverage is at least as good as the mandatory Swiss base coverage .

If you live in the City of Zurich get in contact with the Städtische Gesundheitsdienst and get a letter where it states that your application has been received and is being processed. (You actually should have got such a letter automatically). Forward a copy of this letter to SWICA. Then you fall under "oder ein Gesuch um Befreiung einreicht." category.

If you live outside contact the Kantonale Gesundheitsdirektion to get the same. Procced as above.

Thank you very much for your advice aSwissInTheUS -- yes Student Care is one of an accepted alternative according to ETH.

I have forwarded my application status from Gesundheitsdirektion's online status tracker to SWICA a few times via email when they asked for the exemption form, but then they never responded to my replies.

I would do as you recommended this time - forwarding the physical letter I received from Gesundheitsdienst to SWICA via a registered mail.

A copy of the physical letter. And yes use registered mail. Or at least A post plus.
In addition also get in contact with the ETH International Student Support (in case you are an ETH student) to get more guidance on the matter. They properly know better how long it should take. And also ask the question on reddit at r/ethz .Better likelihood that someone was in the same situation than on EF.

You are running against the three month deadline after which anyone arriving and living in Switzerland is required to have mandatory health insurance according to KVG. The key issue is why has the Gesundheitsdirektion not decided yet on the exemption. I would focus on that and contact the Gesundheitsdirektion (instead of simply forwarding the tracking status): 3-4 months on what is simple administrative matter is excessive.

Swica sux ! What they did with a student who rented one of my apartments was an absurd. They don’t understand nor respect privacy.

Don’t worry about the insurance, if you lose the time, they will just apply a fine on you.... take your time and wait for the decision regarding the exemption.

An update:

I contacted ETH office and was confirmed that SWICA is not supposed to this. So, now the ETH office contacted the SWICA contact person for ETH students, and we are waiting to hear back from them.

I received a letter from Gesundheitsdienst a few weeks after submitting my application that the clock for 3-month deadline will now stop as my application for exemption is being processed. Most of ETH new students in the group chat also didn't receive it so far; the ones who do are all with European Health Insurance Card. ETH also said it could take up to 6 months to hear back even in normal time, especially now with the Covid situation. There is a student who did internship last March and just got the exemption now.
