vehicle accident - strange process ?

As many already know, I was knocked off my motorcycle a few weeks ago. Now I am catching all the insurance fallout and it appears to me to be a strange process.

History: I had 3rd party only insurance. The driver of the car was 100% at fault (according to witness, off duty cop, and the attending police) and was charged with careless driving.

I notified the drivers insurance company that I would be claiming everything from them including the bike, obviously, clothing, medical bills etc.

The medical bills are actually being settled via my company's insureres who are claiming the costs from the car drivers insurers - no problem there.

The car drivers insurers asked me for copeis of various docs including bike invoice, accessories, clothing etc. All seemed normal so far. They then arranged an inspection by a specialist company. The bike was declared a write off. No issue with that. Meanwhile, the car drivers insurers paid for the recovery and storage of the bike. Happy with that.

This week I received a form from a third company - not the one that did the initial inspection - who tell me the bike is a right off, please send them the cancelled Fahrzeugausweis (vehicle registration doc) plus original keys, handbook, and toolkit. The form asks me to sign over the bike to them so that they can break it and realise value for the parts. The blurb says that where liability is proven then I receive the value of the parts and the car drivers insurers make up and difference but if liability is not proven then I receive the value of the parts less(I think) their costs. Also, the form states that I take responsibility for storage costs after returning the form - this bit is not an issue for me, no way matey, I have blacked out that bit of the form .

My problem is that at no time has a value for the bike been mentioned except when I gave my initial valuation to whcih there was no response. I contacted the car drivers insurers with the details of the third company's letter and form and got a curt reply - I must deal with the third company.

My question is, is this normal for Switzerland. Should I sign the form and handover the bike to this company without having agreed a final value for the bike?

I believe this is normal. I managed to write off a car and a bike through my years in Switzerland and both went through a process like this (as far as I remember). I believe I was offered first refusal on the bike I trashed but elected to go against it.

Check with your insurance company how it is progressing, not his. Do you have Rechtschutzversicherung?

Do you have "rechsschutzversischerung"?
I have it for a small fee a year and they have helped me and saved considerable amount of money in a couple of occasions in the past.

Re: vehicle accident - strange process ?

A quick update.

I contacted the 3rd party's insurers about the letter from the company who requested the bike handover. They said they were kosher so I handed in the plates, cancelled the docs, and sent them everything.

After about two weeks I got a nice letter from the 3rd party's insurers offering my valuation of the bike plus replacement (new) value of all my bike clothing and helmet plus an amount for the inconvenience suffered.

Excellent .

It was actually quite straightforward in the end but I have still learned my lesson and will only do fully comp from now on .
