Empirical evidence would support the view that whenever governments move in and regulate things they cause more problems than they solve. So empirical evidence would tell governments to back down and leave this issue alone.

Empirical evidence also shows, however, that governments ignore empirical evidence that doesn't suit them.

Riding a motor bike in the UK without a helmet is illegal. However when a motor bike accident happens, not all fatalities are head related.

However in respect of peddle bikes, I think its an opinion based subject, and should be up to the rider of the bike over 16 years of age. ( you are in theory safer with a helmet) However I do think that if a cyclist is knocked down by a car in any respect of a helmet worn by the rider, the bike itself should be in a legal state on the road. Ie, have lights, be working effectively as this can not only cause the rider injury but the driver of the vehicle.

The state of cycling in Basel, especially (in a totally unscientific analysis) by women, is awful. Worse than in London where I commuted daily for many years.

I think that as cyclists are meant to be road traffic, we/they should also have a licence. That means taking a test. I did a Cycling Proficiency test at school many (many) years ago - something simple like that would be fine.

But some of the cyclists I've seen obviously don't and can't drive; they're mixing with traffic but have absolutely no clue. The only reason they're still alive is because traffic volume and speed in Basel is low. Plus it seems the Swiss (like I know for sure the Germans do) have "looking out for cyclists" as part of their driving test.

As I believe cyclits should be considered part of the road traffic I'm also against compulsory cycle lanes. And even the non-compulsory ones they have in London which are made by narrowing the road, basically meaning you have to use it else the cars queue behind you unable to pass whilst (understandably even though wrongly) shouting at you to get off the road and use the cycle lane.

Oh, and I'm against compulsory helmet wearing.

I'm quite happy for a compromise to be reached here - I am also not a fan of heavy Government interference, but I think some things are just common sense.

I think it would be quite fair for insurance companies to insist that one is worn when cycling / skiing, and that should a head injury occur that could have been mitigated by wearing a helmet, they should not be liable for the increased cost of treatment.

That way it isn't compulsory, but you know the risk you are taking should you not wear one.

It is similar to wearing motorbike clothing. It is not law that you must wear padded jacket / trousers (except during your test), but I wouldn't have too much sympathy for someone who came off their bike and burnt their legs / arms because they had neglected to take proper safety precautions.

Skiing? Are you mad? Why should an insurance company pay out because you decided to slide down a bloody mountain on long, thin shoes which, it appears, are designed to actually slip around? You should be taking the cable car.

In fact, unless you actually have to visit the top of the mountain you should have stayed at the bottom.

anyway, I wanted to reiterate what somebody else hinted at.. nitpicking laws designed to either 'protect people for their own good' or 'provide jobs for the boys and bring in some extra dosh' are a total joke

some plain clothes police driving around town in unmarked cars videoing and nabbing the truly stupid and dangerous would be far, far more effective

Even so, I get the feeling from the links, that wearing one is slightly more beneficial than not wearing one, except for in rare events (such as the possible added torsion).

Fact is, there aren't really conclusive, unbiased facts either way, so I think until there are, erring on the side of common sense (a protected head vs an unprotected head) would be the way to go.

Either way, home time, safe riding one and all.

Good. Personally I feel that it challenges even your mentions of "common sense" as well.

I too have read both sides of the story and can (begrudgingly) see both points. However, when the Mayo Clinic (highly regarded medical source) in the US recommends the wearing of helmets to possibly prevent head injuries, that is good enough for me...my hair looks like crap most of the time anyways, good to have an excuse . Now I just need to get a bike!

I cannot believe how many cyclists go without one. Every time I drive to the next city on the bendy country roads, I'm sure to pass some idiot cyclists, swerving all over the place but worst of all without any protection. I fear for them first of all and then as was mentioned previously the driver who risks manslaughter charges if the worst were to happen. I try to think that cyclists are wonderful, being healthy , saving the planet from fumes but I think there are many incredibly foolish and selfish cyclists who go without a helmet on the roads. Im not really one for police and laws but if you look at it in the same way as drivers and their legal obligations then I don't think it's such a bad idea to make helmet wearing a law.
