Shouting arguing was shown to be unreliable evidence as the timeline could not be established, they didnt know what language was being used ( it sure as hell wasnt xhosa ) what was the tone, if it was a male or female or from which direction.
If i use my own circumstances a little,

now we are a little cheek by jowl here, new people moved in next to us, they have parties once a month, i notice voices and i can distinguish between german, english speaking nationalities, asian, eastern europe, african. after 10 months i know where and what voices are coming from

when i was growing up, a bit of space between houses, difficult. to tell where voices came, though i think you could notice strange languages because it was a 2 culture neighbourhood.

i think it depends on space and how long you have lived somewhere,

nevertheless no-one came forward in that neighbourhood and said we were having an argument at that time (and why wouldn't they to save a man life! especially someone perceived a disability 'hero')

so u can deduce maybe?

1 these people who reported this were lying but for what motive?
or
2. there was arguing.

Re: Oscar Pistorius arrested

The last verdict might actually be short lived because the state is urged to appeal.

Re: Oscar Pistorius arrested

Watching the program on BBC3 now... the prosecutor was also basically tearing his story to shreds, saying how it makes zero sense that he didn't see her get out of bed, and that she never once made any noise to alert him that she was in there for the whole duration of the incident.

It's such a BS story, and I feel so sorry for her parents who must believe that justice will never truly be done.

I am surprised that nobody had noticed in the court that the whole story was BS, they should have taken a better look at the prosecuted:

You get woken up at night, allegedly, by disturbing noises coming from the bathroom....

what is your first and automatic response??...

Where is your partner who is asleep beside you??!!!

MURDER..... first degree.

He didn't even get woken up by it... he had already woken up to open the patio doors and get some fans. It was when he came back into the room that he allegedly heard 'the noises'. He then said that he grabbed his gun from under the bed and then ran to the toilet, and started shooting. He said he thought his girl was still in bed, and that during the whole time he was never led to believe that it was her in the bathroom. His defence lawyer even (with, admirably, a straight face) even tried to argue that she could have been in the toilet hiding, staying quiet and not wanting to draw attention to herself while he dealt with the intruders. So, when he was presumably asking who was in the toilet etc etc, she then didn't say a word in case it was some kind of cruel trick by a masked gunman who was using Oscars voice? Nothing about it makes any logical sense.

It's such a paper thin and improbable story and version of events that he was incredibly lucky to have gotten away with it. I'm pretty sure that in a UK or US jury system he would have been banged to rights.

"It was pitch black... maybe she had got out of the bed in a way I didn't see, such as via the foot of the bed..."

Yeah right... *nods slowly*

I really recommend watching the videos of his testimonies, they are most enlightening, in a: "Oh my god, the judge really fell for that?" kind of way.

Re: Oscar Pistorius arrested

To not find him guilty of premeditated murder beyond a reasonable doubt, I can sort of get. Fine. But this part is ridiculous (from Reuters):
Quote:
However, she also absolved Pistorius of a lesser charge of non-premeditated murder on grounds that the state had failed to prove intent or 'dolus eventualis', a legal concept that centres on a person being held responsible for the foreseeable consequences of their actions.
How does firing 4 bullets at an unseen maybe-intruder (you know, just in case) not qualify?!

The judge seems to be implying a prison term when she eventually gets round to passing sentence

I wish she would just get on with it.

Totally sick of the wall-to-wall coverage of this.

I wonder if he'll get one last night of freedom, to go out and get legless, before he settles down to read OJ's best seller: 'Murder - and How to Get Away With It'.

Re: Oscar Pistorius arrested

5 years is NOT enough, it should be at least 10!

His parents are rich, so this will certainly go to an appeal. http://www.bbc.com/news/live/world-africa-29633280

Outrageous. Could be considered for release after 10 months.

Re: Oscar Pistorius arrested

Frankly, I find it a disgrace for our legal system and how human life is valued. We are talking about death of innocent person and proportionate punishment for such crimes.

I'm disappointed. It makes you thinking how the crime overall can be stopped when the criminals do not suffer serious repercussions.

He would not be released but could get house arrest after ten months if he meets all the conditions. I think that is unlikely. Neither side are likely to appeal the sentence

The prosecution lawyer just said that it was the right sentence

I`m disgusted. What a farce of "justice".

The murder victims family must be feeling really let down.

According to the verdict, she wasn't a murder victim, though I am sure that many people disagree
