In the above case, the difference between the SA law and the US law has been described here:

http://contributors.pressherald.com/...n-and-u-s-law/

However, this part is a bit confusing:

The judge could find Pistorius guilty of murder, of a lesser homicide charge, or acquit him all together. Whatever verdict she reaches, South Africa does have double jeopardy protection and so Pistorius can't be tried again for the same crime once a verdict is returned.

TIA
I guess that's how you get around double jeopardy. He's not re-tried but a new court decides the previous one was wrong on the verdict. That can happen in the U.S. where a murder conviction gets thrown out, but it cannot happen where a manslaughter conviction gets raised to murder by the appellate court.

Re: Oscar Pistorius arrested

After his manslaughter case was changed to murder last week, for the time being, he avoided going back to prison today, by getting bailed out (450 pounds) till the next rounds of proceedings on murder charges start - which by the way is April 2016.. It is suspected that his lawyer will also lodge an appeal against his conviction before the constitutional court.

I believe his sentencing is to be carried out today. I am wondering what sort of sentence he`ll receive for this murder? Apparently the court case is live on TV in South Africa.

I certainly hope he gets more than 15 years!

It`s established his intent was to kill - never mind "who" he thought was behind that closed door.

Re: Oscar Pistorius arrested

Did anyone else see his pathetic demonstration in court yesterday? He took his blades off and walked a bit wobbly on his stumps of legs.

The defence argument was that at the time of the murder his blades were off and he was feeling frightened as he couldn't walk properly. I thought this demonstration was a pathetic attempt by the defence to gain some sympathy.

Isn't a bit strange he managed to move across to the bathroom and without holding onto anything, he could to fire several bullets and not lose his balance? I think he was lying, and it was obvious.

That little show was stage-managed by his lawyer, in my opinion.

All times of his court appearances he`s been immaculately coiffed and groomed... this time his hair was awry and he sported a graze on his forehead, looking like a forlorn and helpless child. And so wobbly on his stumps, with quivering wavering hands reaching out to steady himself.

Yet he got to that bathroom, armed with a cricket bat and a gun? On his stumps? No free hand to clutch at supports?

My sister in SA who follows the court case says she read that girlfriend had a suitcase on the bed packed with her belongings, and she`d gone into the toilet with her mobile phone. Not much more being said about the screams the neighbors heard before being silenced by gun shots.

Apparently, the law is that murder is the intent to kill. Not "who" you intend to kil (if you kill the "wrong" person makes no difference. Therefore he`s charged with murder.

The prosecuting council declare that the "remorse" and "broken man" with tears he is showing is self-pity.

Ja, prison in South Africa is NOT a nice place to be in. And sometimes even money can`t buy your freedom from justice.

(By the way ..... in his sporting career he was also a bad loser)

This is rather shockingly moderate sentence for this kind of crime ...

Oscar Pistorius given six years for Reeva Steenkamp murder

I agree. Truly shocking. Six years prison for killing someone who was behind a locked door? A new precedence. I believe one gets more than that for smacking a stranger in the face!
But then again, I do know, in South Africa it is all dependent on "how much money one has" that rules the halls of "justice".

Re: Oscar Pistorius arrested

It's looking likely that there will be an appeal. Quite why the judge is allowed to keep their job I don't know, as their judgement has been questioned previously.

Is this 6 years on top of the previous 5 year sentence or is that one wiped out by the new one?

Six years but out in three. But 36 months is an awfully long time to be getting violated by your own prosthetic leg off of a 7 foot Zulu.
