Not true at all.

There can be a successful criminal case which then leads to a civil case. In fact had Andrew been convicted criminally when Epstein was, for example, you can bet there would have been a similar case brought by Giuffre afterwards.

Civil cases are about redress of personal losses/damages.

Criminal cases are about redressing "society's" losses/damages.

Not necessarily. Sometimes this is done just to bring an end to the public, and very damaging, litigation.

I hope he has enough equity in his Verbier chalet to pay for it.

I'm surprised. Obviously they prefer not to be in the public eye under these circumstances but I really thought he'd try to get his name cleared. Really surprised.

Whatever the outcome, he could never clear his name, the smell will always be around him, snigger snigger, even if he was found totally innocent by a jury, which i think maybe difficult.

I think that last part may be it - without being tried they can't remind everyone he was proven not liable but in civil suits the burden of proof is less and they *really* don't want a situation where he's been made to remedy.

"A statement in the letter to US judge Lewis A Kaplan said the duke would make a "substantial donation to Ms Giuffre's charity in support of victims' rights"."

That's from the BBC link, I assume it's in addition to settlement money but it isn't entirely clear.

And presumably the case would have been going on during Liz's 70 years on the throne year. I wonder whether that was intentional?

Anyway, that could be another factor in settling.

He's finally admitting to regretting his association with Epstein and is showing sympathy towards Epstein's victims.

Virginia and her lawyers have won and now Andrew can deal with the aftermath and begin to repair his reputation.

I don't know. I think they each gain something by settling. If it's only her charity that benefits and not her personally, she can largely shake off the golddigger accusations that have flown around. She's now helping victims. And her lawyers get a big payday without having to go through a trial.

A trial also meant that Andrew's team would have access to depose (interview) her and her friends and employers, etc. and dig up anything and everything from her past. For example, if she sued Epstein all those years ago, why didn't she include or separately sue Andrew then?

Although the burden of proof is lower in a civil case, he probably could ask for proof that she was forced into getting on private planes and jetting off to private islands. He could ask for passport records, copies of any IDs used (fake ID to pretend you're older, anyone?) bank statements, social media content even if deleted, etc. It would have been ugly, but it would have been a legal way to defend himself.

This way they both get to save a little face and hopefully put it behind them. His reputation is still a mess though and I don't see that changing any time soon. She's still someone who was at the very least manipulated and that feeling won't go away even with more cash in her pocket.

The charity is just her way to avoid paying her fair share in taxes. At the end of the day she'll make sure she gets at least the same using the charity as without, with the balance going to recipients of her chosing. Those will owe her a favor in one form or another in return.
