Is this offer for ipod real or scam?

Its from Ricardo and the pictures from this ipod touch 8GB top Zustand for 40 CHF ( top left ) is the same picture as alot of the other ipods that he's selling. I asked the seller if this was the picture of the actual ipod that he's selling and he said yes. Then I asked him why are all the pictures EXACTLY the same picture. He said they are all in "top Zustand". Something fishy here?

1728 sold items, 99.65% positive reviews. I'd say it doesn't look like a scam, but just a rather lazy seller who doesn't want to photograph multiple ipods in good shape.

Of course it is. That's why setting up a company, bankruptcy, divorce, and a host of other legal processes are EXACTLY the same in Switzerland as they are in the UK. Not to mention the Swiss constitution, modelled as it obviously is on the British... erm...

Its a misrepresentation when I ask him if its the actual ipod thats in the photo and he says yes and its not.
And in all the photos they have the same serial number.

it is VERY common for people to use the same stock photo when representing the same type of item in the same condition. Happens with card, electronics, etc etc. Just accept it instead of acting like an idiot with all this talk of police and getting yourself worked up into a frenzy over nothing. You're probably going to have a heart attack in the next couple of years if you carry on like this.

Have you physically actually received the iPhod, or are you just making assumptions? You are objecting before you have even made the purchase. Also, top zustand does not mean "perfect" condition.
