Does de-registration allow early lease cancellation?

Hi,

I understand that if you formally de-register at the commune in anticipation of leaving Switzerland, then this allows cancellation of most (all?) existing contracts for services. For example, Cablecom and health insurance. Standard notice periods don't apply.

Does this also apply to a lease? I have a standard residential lease with a 3 month notice period to terminate. However, I may have to leave Switzerland at shorter notice than 3 months (that is not as dramatic as it sounds!). Would my de-registration also allow lease cancellation or would I still need to find a replacement tenant?

As I am going through the same "fun" of deregistering, etc. I found out that the above rule does not apply to the flat - you still need to find a replacement tentant if you leave before the 3 month notice, or you are otherwise responsible for the rent until the end of notice period. At least, that's what I was told in Zurich. Not sure about Vevey.

Hi guys
I am just about to go through the de-registering at the gemeinde to leave from Zurich in about 2 weeks, I was under the impression that it was a simple precedure to turn up at the gemeinde house and sign a few sheets when you say the word "fun" does that mean its a long process and should I start it pretty quick

It is standard practise throughout Switzerland, you need to find a replacement tenant whom is willing and able to pay the rent. Note that you are also responsible that he pays until the end of your existing contract, if he doesn't you have to cover the loss!

You need to start getting ready to leave a month before hand. Rental contract, electricity, phone, health insurance, car insurance. The earlier you tell these people the happier they will be.

The rent and utilities are all sorted my end so thats not too bad I was just a little worried that there is possibly some hassle when you go to the gemeinde that they need posibly week or 2 to sort you out

My Gemeide processed my deregistration in 15 minutes. I have, soon to be had a 'B' permit.

I wouldn't worry about too much about that process, they're mainly interested in your tax affairs ie. that you don't owe any.

I'm having some landlord fun too...!!

Hi There

We are another family in the process of leaving as well.
Yes, you definately need to bring a new tenant otherwise you will have to pay until your notice period is up.
I also just figured out that the managing agency of our house, does not do the handover with us unless we have a tenant. So we will have to appoint one of our friends here to do the handover after we have left.
What do they check with the tax authorities, that you don't have anything old outstanding? or do we now actually have to do an early return for 2012?
Has any of you figured that out yet?

Here is a tip...

Cancel any direct deposit payments for bills ASAP and go back to paying on the paper bill.

It is very frustrating to get these cancelled once you have left. It took me 4 months to get them to stop taking health insurance payments from my bank account and we gave them 3 months notice we were leaving.

You have to find a tenant, or be responsible until the end of your contract. The tenant that you present has to show fiscal ability to pay the rent. If during the application process the potential tenant was rejected but was willing to sign to take over your contract and had the fiscal means to do so, you are off the hook as if the contract had been taken over. Good luck, this is definately a landlord driven society!

Also, deregistration is not as easy as saying "I want to leave". You have to either submit paperwork from your company that they are completing your tax paperwork and following up with you to make sure you pay all your taxes, or you must pay your taxes yourself before you can leave the country.

You must find follow tenant. Until that time, you must continue to pay on current lease. Good Luck!
