No win no fee legal advice

Hello


I moved away from Switzerland several years ago: unfortunately it did not end well.


I need to find an English speaking lawyer prepared to take on a case on a percentage of recovered funds basis.


Any suggestions gratefully received so I can put a line under this episode of our lives.

Thank you for your quick response.

It is a dispute with my bank in Vaud regarding poor mortgage advice. A threat to take my complaint to the Ombudsman got them to act, but unfortunately it simply postponed the problem rather than resolve it.

I would prefer not to go into more detail than that in the forum but am happy to communicate by email if that is appropriate.

The lawyers here have set rules about calculating their fees, I don't think you will find one that does "no win no fee".

My guess is the OP took out a long fix & wanted to get out of the deal. Banks don't really give mortgage advise, they have a few options which customers choose the one that will suit them best. No doubt it was all spelled out in the contract that he signed.

A "No win no fee" agreement with a lawyer is forbidden in Switzerland. It's only allowed to offer a "percentage of recovered funds" as a bonus, but not to the exclusion of the lawyer's regular fees.

This rule has some negative facets, i.e. valid cases not brought for fear of the costs, but on the positive side it does suppress a lot of spurious cases and keeps the legal system free of ambulance chasers.
