Leaving Switzerland but have a house contact

this question for my uncle. my uncel is swiss citizen. but he is going pension and move to other country. already he deregister from kanton. but he has a house contact with somebody like share house contact. so this moment he need to cancel this house contact or not. because if he move here again here then he want to live again this house. anybody know about that.

No, I don't think we know about that.

If he cancels a normal rental contract he'll be able to stop paying rent according to the termination clause of the contract. Even faster if he finds a 'nachmieter'. Either way, if he comes back some time later, there is a very good chance that the rental will be rented out to somebody else and unavailable to him.

The only obvious alternative would be a short term sublet during his absence, but that is hard to justify if he doesn't know how long it will be for.

All this seems a bit obvious though, so I'm beginning to suspect that there are important details missing. For example, 'shared appartment' is ambiguous. If it is a WG situation, is he on the contract, or subletting from a primary tenant? Etc, etc.

this house contact is me and my uncle name and he is already in pension. so he want to move for few month another country like 6 month. so already he deregister from canton but until this contact both of name, so this moment he need to cancel his name from this contact or he will be able to continue his name this contact paper.

If he wants to come back to the same apartment after 6 months, he just needs to continue paying the rent.

khanshohag86, I'm not entirely sure, because your English is hard to follow.

[You don't seem to be a good enough writer to dispense with capitals and punctuation on stylistic grounds, and I would encourage you to reconsider their disuse.]

However, I think that you are saying that both you and your uncle are listed on the rental contract for a shared flat, and now he is going to be deregistered and out of the country for 6 months, but probably not permanently.

If this is the whole story, and you will simply be alone in the flat for those 6 months, you might not need to do anything - just keep paying rent. In theory the landlord reports to the commune who is renting the flat, but I think that is mostly to keep people from moving in without registering.

On the other hand, if you were going to sublet his room for those 6 months, then the rules say that you tell the landlord about the sublet and at that point you'd probably also want to explain that your uncle would be out of the country for some time.

also keep in mind that if your uncle wants to return he needs to make arrangement to keep his permit (it goes something like on a standby). However then you are not able to cash out the pension fund!

No. OP wrote that his uncle is a Swiss citizen. So no permits to consider.

That rental contract does not automatically change if Uncle moves out, if Uncle de-registers or even if Uncle leaves the country.

If Uncle wants the right to come back and stay again, whenever he wants to, he should carry on paying his part of the rent. That's fair and right.

But when an owner/agent makes a contract with two people, it usually says that they are each INDIVIDUALLY responsible. So if Uncle just leaves and does not pay, Nephew will probably have to pay the full rent.
