Help with de-registration (keeping my B Permit for short time)

Hi, We have a conundrum and would appreciate your input.

I am Mexican, pregnant. I have a B Permit, living with my husband who is German. Because of his job, we need to move to Germany the same month I am due to give birth.

Can my husband register in Germany while still being registered in Switzerland? That way I keep my B permit for the 3 months (max) it would take the german consulate in Switzerland to process my visa.


Since he needs to register in Germany first, if he de-registers from Switzerland I lose my B permit (family reunification dependant) so I would have to apply for a German visa from Mexico and give birth and wait there.

Is there a grace period to de-register from Switzerland? We are willing to keep paying health insurance, rent, services, taxes, anything necessary to continue being registered here at the same time that he is registered in Germany. His job would be with the same company, only not in Switzerland.

Hi, I am actually aware of one such similar case that happened a couple of years ago where both husband and wife were non-EU and husband got a job in Germany but wife wanted to stay in Switzerland for delivery as it was due fairly soon.
As far as I recall, they visited the commune/migration-office and explained and wife was given a permission to have a limited extended stay.
Best would be to talk to your commune/migration-office.
I am not sure if there are definite rules but generally the commune/migration-office are considerate in such cases

The two matters (registering in Germany and/or de-registering in Switzerland) are not so much related to each other as you seem to think.

I mean usually first people tend to de-register in CH and then they move to another country and register over there, but nothing bad will happen to you if you don't do it in the exact same order.

In Germany, I would be surprised if the authorities care about your (husband's) exact residency status in CH. If you / he has already de-registered there, or will do it later.

Same in CH, if you go to the commune in Lausanne at one point of time to de-register, they will ask you to provide your next address (so that they can reach you in the future if need be), but they don't care if you have already registered there as a resident at that time, or will do it later.

So, in case for whatever reason you still don't want to de-register, and you still have your health insurance and rental contracts active, then simply just don't do it. Cancel your contracts with the date when you're OK to leave, and de-register accordingly.
