The criminal law provisions against racial discrimination, protects the dignity and worth of man. Article 261 bis of the Swiss Penal Code (Penal Code) and Article 171c of the Swiss Military Penal Code (MStG) acts a criminal offense, that person because of race or because of their ethnic and cultural background, explicitly or implicitly denied the equal existence, or they did right to exist is denied . The actions are, however, prohibited only when committed in public, ie exists among the people present no personal relationship and trust. The creation of the criminal law provisions against racial discrimination was in accordance with Articles 2 and 4 of the CERD to the duties of Switzerland. The exact wording of the Criminal Code, reads as follows:
who calls related to a person or group of persons because of race, ethnicity or religion to hatred or discrimination,
who publicly disseminated ideologies, which are directed towards the systematic reduction or defamation of members of a race, ethnicity or religion,
who is organizing with the same goal propaganda campaigns, promotes or participates in,
who reduces public by word, writing, images, gestures, assault or otherwise a person or group of persons because of race, ethnicity, or religion in an attack on human dignity offending way, or discriminated against or any of these reasons genocide or other crimes against humanity denied, grossly plays down, or search warrant,
who refused an offered him power, which is intended for the general public to a person or group of persons because of race, ethnicity or religion,
shall be punished with imprisonment up to three years or a fine.
