Opening an online shop - help with small print & payment gateway

I am opening up an online shop here in Switzerland but I am not experienced in this.

All websites have a "general term and agreements" - can one write this yourself or do you need a lawyer to get your back covered?

Also, anyone know a good payment gateway for magento?
