Help PLEASE - traffic ticket - No Speeding

Hope someone can shed some light on how to appeal a trafic ticket. Long story short: my wife drove our car and got pulled over for a routine contol. Police office detrmined that the front tires were 1mm below the offcial allowed profile. No issue there, we replaced the tires the next day.

Two months passed and today we received two tickets. One for me as the owner of the car for 390CHF for allowing someone to drive the car, and secong for my wife for 580CHF as the driver.

This seems to be way out of line. The admin fees out of 970CHF total are 470CHF (what for I ask myself).

Any thoughts what I can do about this. What I do not understand is this is a family car, my wife drove it not a 3rd party, so why two tickets?

Any help is much appreciated if you have some ideas on how to appeal this. It was issued by Meilen city office.

Not at random, they generally do such stops here. Saw one today, other direction, at the top of the Ceneri, wife said she's been controlled a few times in the past months.

Now, you got 2 tickets because a) the owner is responsible for the condition of the vehicle and b) the driver is also responsible for the condition of the vehicle.

Had the driver also been the owner, perhaps you would have gotten off cheaper, perhaps not.

This is a very serious matter as 2 tyres were defective. 1 tyre would be a fixed penalty notice of 100chf, this matter has been dealt with by a judge, that's what the costs are for. Pay up, if you appeal it will be VERY much more expensive. Both you & your wife are guilty what are you appealing against?.

As the limit is 1.6mm, one mm below is basically bald (though winter tires are 4mm, as I recall)

Count your self lucky you did not get caught in heavy rain and have a serious accident.

I'm confused at to what the extra fine is for. I know we switch off on driving each others cars. So I'm thinking the fine is not for that but for the tire issue. Is that right?

Ah, didn't realize the limit on summer tires was that low. Still...1000 chf?

Thanks all for your comments. My issue is that we both are owners of the car so why two tickets. Seriosly the tires were not bald, I am not that crazy or stupid. we had a check-up at the garage a month before and nothing was mentioned, the guy told me next year I should look to get new summer tires for this season they are ok...It is what it is I guess....

I'm confused. Is the fine for the illegal tyres or because they thought your wife was driving without insurance/licence or something?

Feel sick and it's not even me but it is what it is... Pay up if you can or be prepared for a long appeal process.

There is a small chance as you say you went to the garage and he said it was ok. If you have that in writing there must be a way...

Officially, the limit is 1.6mm regardless of whether you're on winter or summer tyres.

Practical advice is that summer tyres need to be replaced when there is <1.6mm remaining, while winter tyres need to be replaced when there is <4mm remaining.

No my wife has a Swiss license and has insurance. We both are on the insurance and registered owners of the car. The front tires were below the official allowed limit. She was driving alone. The police office called me the next day to confirm my info and told me "Sie werden eine kleine Busse per post bekommen" meaning I will get a small fine per mail...Well what is a big fine if 1000CHF is small wtf...

390 is a small fine where a judge is involved.

It could have happened that the wear was stronger on the inner sides, while the tires appeared to still be OK when looked at from the outside. The profile might not go below 1.6mm at any point.

If it was up to me, I would raise the minimal profile requirement for summer tires. With only 1.6mm left, there's not much left to evacuate water at higher speeds. I always change my tires earlier than that.

Who does the registration document say is the owner of the car?

Is it even possible for a car to have two registered owners?

Maybe it is in Swiss, but would be unusual I think.

OK my better half just corrected me...The allowed thread is 1.6mm, ours was 1.5mm according to the "young" officer - so not 1mm but .1mm my bad...I wish I was there to put his glasses on to double check...

So all better check .1mm in Switzerland will cost you 1000CHFFFFFFF

In most countries, there is provision to issue fines to both owner and driver if they are two different people for vehicle compliance offences.

What I find a bit stupid is, that in most countries these are on-the-spot fines...you know the amount at the time and you have usually about 1 month to pay. In Switzerland, so many fines require court processing...and this seems to be a big cash cow for the local and cantonal administrations.
