Is Jan 2nd a Zurich official Holiday

Hi, does anyone know if 2nd is official holiday and what constitutes it being official or not? Our employer says its not and we do not get it off.

It is not a legal holiday in canton Zurich. It used to be customary for offices to be closed, but this is by no means compulsory (unless there is a collective bargaining agreement [GAV] that stipulates it's a day off).

Employer is correct.

If you are used to getting a day off as a replacement to a public holiday falling on a weekend then it is now time to adjust your expectations as that doesn't happen here.

that is not true, the entire Bahnhofstrasse is open. I got to the sales every year then and get some good bargains.

According to your link, it's not an official holiday. AWA agrees. So while an employer may be a bum [(c) Bob Hawke] if they ask you to work, they're legally entitled to do so unless there's a GAV that says otherwise.

I asked my line manager (at big company in ZRH) and he said that yes it is a public holiday and that we'll be getting it off.

Hi all, I was trying to find out if 2. Jan a legal official holiday as some told me it is, some said it's not.. found this thread..

I read on the AWA page, it is categorised under 'Lokale, nicht gesetzliche Feiertage in der Stadt Zürich'

However, on the right hand side of this admin.ch page , the pdf stated 2. Jan under 'Gesetzlich anerkannte Feiertage' ..... (Verzeichnis "Gesetzliche Feiertage und Tage, die in der Schweiz wie gesetzliche Feiertage behandelt werden" pdf)

The Amts are open on 2 January (having been closed since the 24th!) so I think that that is probably a good indication that it's not a public holiday. Seems some companies give it in any case, so best check with your employer. Agree that it's confusing

It is a bit confusing formulation, but what it says is:
There are two kinds of holidays:
- Public holidays
- Local holidays


The local holidays are to be treated as public holidays. This is probably some artifact of Switzerland being an interesting federation of cantons.

One poster says that an employer is within their rights to say it is not a holiday. I wouldn't bet on that, considering what that link from the Bundesamt für Justiz BJ says.

It is recognised as an holiday, but it is not a legally enforced holiday in Zürich. Labour law also says that kantons only are allowed to appoint 8 days as to be equal to a Sunday.

This link you gave shows 9 (https://www.ejpd.admin.ch/dam/data/b...-feiertage.pdf) So one of them is not legally enforced, and that is the 2nd of Januar.

The link is not wrong, it is just not the complete picture when you only look at the list.

Important: On days which are equal to a Sunday you are not allowed to drive a commercial truck. This is another list, which can be found here:

A canton cannot add a day to this list, but if a day on this list is not a Holiday equal with a Sunday in a specific canton you can drive a truck in this canton.

I seem to remember that used to be different and was changed.
