microspot.ch - no returns - Betreibung?

I ordered a 500 CHF computer component (memory) from microspot.ch, and despite it being advertised as being compatible with a certain other computer component (a type of motherboard) it turns out it isn't compatible.

I contacted support@microspot.ch within 2 days of receiving the item and asked them about how to do a return, and they said the following:

"We are sorry, but on our site it's written that it's not possible to return article to microspot.ch. We are working with different suppliers and they don't accept that we give items back to her."

Is this even a legal policy for them to have?

Can you please tell me how to go about making a "Betreibung" (small claims court) against them to try and recover my money?

In any case I would strongly recommend not ordering anything from microspot.ch.

Completely agree, they are at best 'box shifters' with cheap prices but nothing else. I had the misfortune of buying a Cinema sound system from them that turned out to be a grey import (from Austria) so the Swiss distributer wouldn't touch it when it developed a fault.

You are not the only one.

Is it legal? Yes and no. Yes, they can say that there is no return but only if nothing is wrong.

In there AGB they say "Sämtliche Produkteangaben, Produktefotos, technische Spezifikationen, Zubehörbeziehungen etc. erfolgen ohne Gewähr. Massgebend sind die gültigen Spezifikationen vom Hersteller zum Zeitpunkt der Auslieferung bzw. Abholung." - "All descriptions, specifications, photos, etc. are without guarantee. Only the manufacturers specifications at time of delivery are valid." Hello, with this clause they could send you a 32" pizza named "Samsung 32D3000" instead of a TV.

Now there are three ways how you can fight back:
First way: Did you get what you ordered? For ex you ordered part number XYZ and you got XYZ. If not, request XYZ. What does the manufacturer say about compatibility of part XYZ? If according to them it is compatible they have to take it back according to their own AGB. This is the easy way.

Second way: You have to fight against the clause in the AGB. You have to claim that it is unfair, one sided, surprising and unusual. This may be the hard , may take up to 2 or three years when it goes all the way, and could cost a lot of money if you will loose at the end. AFAIK, you will be the first one who goes all the way.

Third way: Get in contact with Saldo, Beobachter, K-tipp, Kassensturz etc.

See Swiss Code of Obligations Art. 97 ff and Art. 187 ff Specially Art. 197, , Art. 199, and Art. 201

PS: Per AGB you have to fill your claims at the Kreisgericht Burgdorf / BE.

We are having the same experience with microspot. Bought a Handy and from the start it did not work. They would not exchange for another. " it has to be sent back to manufacturer"!!!That was one month ago and still nothing. Many emails sent to them but not one reply. They are just a Mafia business with the backing of Coop. Luckily we have not paid yet. We will only pay when we get a new one in return, and if they threaten us then we shall seek legal advice. They should be reported.

More and more websites/companies from the US and elsewhere are offering free two day international shipping with customs fees included (or you can pay a fixed fee and they take care of the fees, even if higher), and with typical US style service. My wife had a problem recently. It wasn't even the company's fault (shipper was to blame). They corrected it and even gave a discount on a future order.

It will take time but horrible customer service here will improve.....or it will be "outsourced" by the customers themselves.

Sorry about your bad experience and thanks for the heads up.

That's why Toppreise is not a great judge of pricing... 75% of the stores it lists are cowboy box-shifters with non-existent customer service. They reel people in with the cheap prices, then wipe their hands afterwards. If im selling anything I only use the first price in the list of a trustworthy company, which is Digitec... if someone wants to argue over the price and that they can and get it cheaper at Microspot or PowerCH then fine, go ahead.

Digitec is the only online electronics company in CH that gets my money. I have had 3 issues requiring customer service with them and each time it has been dealt with quickly and efficiently, and if I have any issues I know I can go and see them personally and be dealt with courteously. I would rather pay a little extra for that kind of peace of mind any day of the week. I would say that barring the lack of Distance Selling Regulations they are as easy to deal with as any UK companies i used in the past.

Just don't go to the Dietikon branch. Every experience I've had with digitec online and in other branches has been positive - every single time I have to go into the Dietikon branch it's like a trip to a sadistic dentist.

I got my refund rather quickly. I sent them a message in German explaining that I would like a refund considering the substantial delays ( clearly proving the fault lies with them ) despite claiming the items were in stock, then emailed them a screenshot of the transaction from my PF account, and they responded acknowledging the request and got it within a week.
