Rights to return faulty goods (from geman site)

Hi
End of November last year, I bought 2 Luceplan lights from a german website Ambientedirect.de. 1 was out of stcok for 2 weeks.

After endless emails and non response from them, last week they confuirmed that the one that was in stock was now out of production but they would send the other. I got it last week by DHL. The 'luceplan box' (ie not the outside case, was really badly damaged and taped up looking like a customer return. A piece was missing meaning i can't assemble it. Its slightly scratched in places, meaning its probably ex display or a return.

The company are now saying its not their responsibility< to pay for the return. However, they offered to pay upto 90. I think it'll be double this knowing swiss post! secondly, they offered only an exchange or credit note!!

What rights do i have that they pay the full costs for delivery and I get my cash back. The are supposedly a large company, but I should have checked the reviews as seem this is common practice...

It's only 3 hours to drive to Munich - jump in the car and take it back

That's what I would have done if I had bought it in a shop locally.

Your rights are to an object exchange, a repair that works or finally, your money back.

YOU have to pay for the return postage, always!

Which is why I am very hesitant to buy anything from catalogue/on-line in CH- pay 7CHF for postage, and if you don't like it, doesn't fit, etc- pay another 7CHF for return. In UK catalogue prices include postage and free returns.

Good idea to send it from germany, i work about 30mins from the border. would still need them to give a refund. will see now how they want to react to my claims. thx for the idea
