Creditreform Ricardo not paying fees

I listed an item on Ricardo some time ago. It never sold and I removed it a couple days later.

I remember being emailed the payment reminder but I just totally forgot about this. The issue has since been escalated to Creditreform and the price has been exaggerated.

I have no intention of paying this, but was wondering what are the consequences? If the amount is not paid do they take it to court, or just put a mark on your credit file? Or is it like the UK, and you simply ignore these "threatening" letters and nothing actually happens?

I'm sure this post will generate the typical responses i.e. you should check your email, you must follow the law etc. What I want to establish here is the boundaries. The UK has laws also, but such credit agency letters can simply be ignored and they never see it to court.

Are you saying you won't pay the Ricardo fees?

I would say you are on dodgy ground there but for the credit chasers I think there are threads about them (or similar) on here which might provide you with some info.

But I think the Ricardo fees need to be paid nonetheless.

In short you'll probably get a first reminder, then a second one with a reminder fee, maybe a third one with an even higher fee and then eventual proceedings (mark on your debt/credit record which is used for applying for apartments for example).

The fee to list an item on Ricardo is not very much, unless you had it on automatic renewal for years.

How much did you owe?

You should pay it because otherwise this will affect your credit record.

Switzerland has a betriebungsregister and if the debt is valid (which it seems to be) you really want to avoid getting a registration in this since it might prohibit getting a loan or new apartment in for example 2 years.

Thanks for helping in understanding the boundaries here. So the general gist here is you have to pay or you will get a mark on your record. Something I dont want so I am happy to pay.

I dont even remember the amount, think it was only a few francs. It is now 21.60 consisted of the below:

Grundforderung 12.50
Zins bis 23.02.2018 0.10
Verzugsschaden 9.00
Total 21.60 CHF

Had a quick read through the stickies, it mentions that I only have to pay the amount owed to Ricardo and no further processing fees etc. So do I only have to pay 12.60 CHF (12.50 + 0.10 interest)? Or is the Verzugsschaden necessary also? (not sure what this is)

Reasonable fees for sending you a reminder are OK - this is probably the 9.00 bit.

Their current AGB actually say it's 10 francs, so you're doing OK.

The fees charged by these illegal debt collection agencies are not that low !

Verzugsschaden have to be paid if they are valid (meaning they cover an actual damage which came to exist due to you not paying your bill.)

You can be a man of principes and demand an explaining for these costs, or given that you are at fault and the amount is low just pay up and have it over with.

I personally could not be bothered by making whatever fuzz out of 9,- more or less.

Thanks for the clarification. Too much headache to save 9chf. I was hoping it was a simple phone call or email and they will remove it. But looks like its far more complicated.

I would earn more than that with the time I will put into it. The only true joy of being in Switzerland $$$

The interest (Zins) is interesting re Swiss interest rates on bank-accounts. Was that less than a year?
You should think about investing money with them
