Unsolicited course and tuition

I received an email that a german language center said I should pay for a tuition for an upcoming course, but I didn't apply for it.

I requested them to unsubscribe me from that course, but they said in that case I still have to pay, as the cost is shared by everyone in that course. Can they just charge me like that? Shouldn't an official sign-up include my signature or something similar?

Re: Unsolicited course and tuition

Did you investigate or request info about the course? Sometimes they sneakily add in a clause that a request for information qualifies as a subscription.

Re: Unsolicited course and tuition

A signature is not needed to enter a contract, your word or action is enough.

How did they get your e-mail address and had you previously contact with them?

Why do you unsubscribe from something you did not enroll?

If I had no previous interaction with them I would have simply told them that there must be a mix up, I am the wrong guy, and they should bill whoever booked the course and will attend it.

Re: Unsolicited course and tuition

I received the response which says:

"Auch eine online-Anmeldung ist rechtlich bindend. Den Fall, dass eine fremde Person jemanden in einen Kurs anmeldet, hatten wir bis dato noch nicht. Ich habe Ihren Fall mit dem Abteilungsleiter der Weiterbildung besprochen. Wir erlassen Ihnen die Zahlung des Kurgeldes von CHF 240.00."

That means they'll waive the cost so I don't have to pay anything right?

You really want to say 'quid pro quo' (an exchange) and not 'tit for tat'
(an injury, insult give for an injury, insult received).

Re: Unsolicited course and tuition

If somebody signed you up without your knowledge (which would seem to me the most logical explanation), it must have been somebody who knows your name, email and address.

I'd start thinking which "friend" or work colleague might be behind the practical joke.

This is beyond my knowledge. Signature is an easy and common way to prove that someone agrees to something. I could think of many examples that easily jeopardizes modern society without a valid proof.

The only thing I could think of is that Switzerland is a very mature society and the trust level is very high. I do have experience of paying the bill after the service is done.

The only connection I could think of is that I took a Deutsch Prüfung there, but that's separate bill which was cleared without issues.

I don't understand this question. They said I'm enrolled but I'm not, so I asked them to remove me from the course.

You don't have any form of internet shopping where you come from? Or cash sales in the supermarket?

In Switzerland there are many contracts that are concluded without a signature.

Getting a public transport ticket, using a paid parking spot, getting something from a vending, or ordering stuff in a restaurant or bar and you must sign a contract first Wow, things would be really complicated.

The code of obligations https://www.admin.ch/opc/en/classifi...index.html#a11 knows three kind of contracts:
Those in written form which need a signature, those which also need a notary, and finally all the rest, which is actualy the default, where one is free how the contract is setup. Can be verbal or even silent.
