Fine from the Police for recycling on the wrong day
 
I've just received a fine from the Police in relation to using the recycling on the wrong day.

One Sunday, our paper recycling was piling up at home, and so I thought I'd go to our local recycling centre. When I got there, there was a chain around the bins, but they were completely accessible (in our village, there's no barrier), so and the bins were open, so I didn't see any particular harm. So I put the rubbish in and drove off.

Today we get a fine in the post, and the fine is for 250 CHF for

"putting rubbish on the public highway or not sorted in the eco-points" which is not true.

The fine for using the recycling outside normal hours is the same, but the crime is wrong, and it just seems unfair, for what was effectively taking my rubbish to the tip.

Furthermore, the fine is in my wife's name, which is not true either.

Any experience with this? Can I complain?

You can try to fight it but the defence of "It was me not my wife and I was actually putting it in the recycling bins on a Sunday, despite there being clear rules and them being chained up" might not stand up too well.

I'd pay the fine and just chalk it up to experience. If something looks obviously closed, don't attempt to use it.

Is your car registered in your wife's name?

That's the information that the stasi-neighbour (to the recycling centre) gave to the Police.
They then must have trawled through the waste paper to confirm it.

People have to much time on their hands (which I suppose, in the case of the Police, is a good thing).

Your wife can appeal. Simple.

Just appeal. Not mention you or what you might have done. As you are two separate people. (Even when married :D)

In Switzerland if it is not a law or rule it is mandatory.

You really have to follow the rules.

Also people report here a lot.

What makes matter worse is that everyone has access to cameras via telephones.

Thanks, it just seems like a victimless crime. I guess I've learnt my lesson, but I would like to ask them to at least correct (e.g. put it in my name, and alter the actual infraction as it's not true).

I will ask them to do it, I was writing a bit indirectly. At least if they're going to fine us, get it right. It was me that did it, and it was I only put the paper in the paper in the paper bin on a Sunday. It's completely accessible. It's not right for my wife to have it against her name.

There's a similar arrangement at the ecopoint in our village in Vaud on Sundays. The area is chained off, but still accessible. There are, however, clear signs stating that the area is out of bounds on a Sunday. Maybe there are similar signs at your one, that you missed?

The "victims" (at least in the eyes of our Commune) are the people who live in the adjoining houses who would otherwise have to put up with the noise of people smashing bottles into the bottle bank or lobbing tins into the metal container all day on a Sunday. The rule is to protect them from the noise pollution. It has to be said though that throwing away paper rubbish is unlikely to generate a nuisance, but I guess there's no distinction between the different types of rubbish and that it's the principle of not using the ecopoint at all on a Sunday that somebody took umbrage too.

Good luck with getting the fine amended/renamed!

I guess it is a lesson, but I think the Swiss have a different attitudes to laws than other nationalities. It was only paper because I was aware that glass might make a noise.

I think they just are unusual in that they apply the rules consistently. If you make an exception because "paper is quieter than glass", it all gets a bit ridiculous and instead of the odd person falling foul of the single and simple rule, you open it up to loads of people who are confused and interpreting it all in their own sweet way.

Not sure it's a Swiss thing - more of a sensible logical thing. :dunno:
