Claim money for not sent purchase

Hello

I've purchased at Galaxus an Dyson air filter to fight with my pollen allergy
The purchase was payed at 29 Apr
At 30 Apr was created consignment number at Swisspost
Since then item was not arrived, the status at Swisspost: Delivery date unknown
Week after I sent a request to Swisspost asking what is going on with the package.
They answered that the package was never delivered to Swisspost
So I decided to purchase same article from another seller and it was arrived next working day
My question is how to claim money from Galaxus nowdays?
I dont want to wait until they finally will send it to me and then send it back (current Galaxus approach)

Always amazed that people cannot think of this themselves...

Send them an E-mail or give them a call.

Tell them the item has never arrived at the postal services and that you due to the delay do not need the item anymore, and that you would like a refund.

Any action after this depends on their response.

Sure i did contact them. The answer was: wait another week then we will do something

As I already mentioned, the problem that their current policy to send item and then I should return it to get my money back.

A sensible approach would have been to contact Galaxus and make sure you had cancelled the order _before_ buying it elsewhere.

If they think it's been dispatched and it's just somehow lost in the system then it may not be possible for them to cancel it. OK, whether it's "possible" is not the point, but whether they're willing to do so given that it might turn up at any point is another matter.

Then why are you asking us for another approach? They've made their position clear, you just need to wait.

yes, I made my position clear: I cant wait because of allergy. I clearly stated to them that I gonna purchase the device from another seller

I've had good experience with refund at Galaxus, just let them know explicitly that you wish to cancel and want a refund.

In my case response was delayed but was satisfactory.

thanks for your experience. I just want to know if there is way to exclude the part with sending 12Kg device back and forth
Since they claimed that device is shipped, I cant cancel it

Well apart from not telling us that you had all ready contacted them and that your question was actually how to break a sales agreement you had already agreed to and get your money... yes you made your position clear.

You're allergic to picking up and returning a parcel if it eventually arrives? Or just allergic to waiting? I think we should be told.

Posters can't know what is the full story, they reply based on the info you provide. Since you keep adding new bits, and probably still haven't told the entire story, they react as if you've been taking them for a ride.

Obviously they're NOT amused. And no wonder.

Now, if you ask nicely someone will probably tell you how to make good for your innocent(*) mistake.

If you paid with a credit card and you are not afraid of broken relationship with the seller in future (some take this quite negatively), you can just chargeback the payment. The seller failed to deliver the service you paid for - so you can just dispute the payment with your bank

Seller is allowed a certain time to send the goods, claiming back the money within that time from your credit-card company is not a good idea.

well, seller claims that goods are sent, Swisspost claims that goods was never received
Money was paid, goods, was not sent after 2 weeks, something definitely wrong here

On the other hand, I would not wait too long neither
UBS dispute module quote for example: "We can only lodge a complaint to the affected company if you object to the transaction in writing within 30 days of the statement date"

short update
wrote them email 2 weeks ago. Got only automated answer that due to high demand they are too busy, please wait etc and so on
called them today. They are still have no clue, where the item is. There is a 3rd party supplier who started investigation with SwissPost regarding the delivery (SwissPost answered me 3 weeks ago that they never received the item for delivery)
still waiting...
