Parking ticket (Zürich)

Today Dan and I drove to Zürich to experience some VR fun (it was a lot of fun, btw). We parked in front of the business, but when we came out less than an hour later, there was a parking ticket under the wiper. Apparently the spot that I parked in didn't belong to the VR business, but to someone else. The signage in the lot was pretty poor, and I'd say that 80% of the parking spots were empty. The ticket is from a private firm (so not handed out by the city). An employee from the VR business was outside when we found the ticket and seemed incredibly apologetic.

Ok, so the question is: what happens if we don't pay this ticket?

Possibly, nothing. But most likely, you'll end up paying, possibly considerably more.

That was my thought as well.

It isn't the cost (well, yes it is, since the cost of the ticket equals the cost of our VR experience - nothing like paying double for your fun!) but the underlying complaint is the principle of me resisting the payment of it. :msnmad:

A lawyer friend of mine told me that those private firms operate in a legal gray area, but that if push comes to shove they mostly win.

Was there a judicial sign, that you're not allowed to park? Gerichtliches (Park-)Verbot gemäss Art. 258 Abs. 1 Zivilprozessordnung (ZPO)

What you got is a demand for "Umriebsentschädigung". Legal between 30-50 Franks. BUT, this is not a fine. If they do have a judicial sign up (which is very expensive to get for them), they have the right to report you to the police.
Now whether it's their habit to do that if the "Umtriebsentschädigung" is not paid or not differs from firm to firm.
So you can wait for the official fine from the police, if you want to.

All correct. But the fine will be from a judge not the police. And might be around CHF 100 or more  (total sum depends on court fee etc.).

That's correct. And the amount (or minimum amount) is even stated on the judicial sign - for everyone to decide if parking there is worth it. :D

Sorry, spent too much on the Jonathan Pie thread, learning that in the US the police does the catching, sentencing and executing now. So glad Switzerland is always a few decades behind "the times".

Just how poor was the signage? I'm guessing there was at least some. That it was mostly empty is irrelevant.

Normally only the maximum amount is stated, which is normally only used for repeated offenders. The highest I have seen so far is CHF 2000.

They do sentencing now? looks like the protest have not been in vain.

Very interesting.

This is the street view of where I pulled in:

And Dan had taken a photo of this sign after we got the ticket:

I assume that this is the judicial sign that you mention?

So based on that, it looks like the fine is legit, no matter how asinine it is. :msnsarcastic:

Yes, this looks rather official. Except for the FCZ sticker.

That's what makes it official!

It is not a fine but a "fine", an administrative charge (Umtriebsentschädigung) to be correct. If they call it a fine (Busse) i would not pay it.
