Real branded bags held at customs!

Hi all! My family sent me 2 of my used LV bags from my hometown, however, the parcel was being held by the Zurich customs and they suspected them as counterfeit. The truth is I brought them in LV retail stores when I went to Paris few years ago and I am sure they are REAL! They asked me to contact the brand lawyer directly but I didnít get responses yet. How will the procedure next? They have no right to destroy my bags right?

I wish I do but I didnít keep them. I read some information on internet and say they will find the brand staff to check right? As those are real, I donít worry if they check. Just hope they could release the items as soon as possible...

Don't forget that if they get released, you'll have a customs bill to pay...

That said, I would assume that the onus of proving they are fake rests on the customs agent...

The issue will be if the value of the bags was not declared correctly for the post. If it was under-valued they will suspect counterfeit.



Personally, I would be less worried about how fast th ebags will get to you, and more worried about either paying a fine for them being counterfeit, or the tax plus handling because the value was not declared properly.


Anyway, I would say to phone the brand lawyer directly if you can - but everyone's pretty much on holidays at the moment.


It's highly unlikely the bags will be destroyed - if they are fake, they will be held as evidence, and if they are real, they are high value items being held at customs for clearance.

How can you prove they were used? Without a receipt? With, say, shoes, it is easier- but with bags?

OP says they're a few years old. Should show some wear-and-tear, no?


That may also be the reason that customs suspects they're fake: not the current models anymore and slightly used.


Or are they ceramic coated, warpped and just repel all dirt?

If you bought them in an LV store, they keep customer records of purchases at least 5 years. And customer details even longer. So a quick call will get you a duplicate receipt.

If bought new, and the original invoice is made out to you, and being sent to you, even after 2 years, customs will assess the value based on what you paid for the items, even if they are a bit scuffed. However, if they are scuffed, that is a bit of a red flag, as LV bags are usually kept by their owners in pristine condition due to the cost of them.

I was living in Singapore and my OH gave me an LV wallet one year for Christmas. Fast forward, 3 1/2 years later, on a trip to Malaysia, my purse and wallet were stolen.

In order to make an insurance claim, I had to provide receipts of items in my purse. I didn't have the wallet receipt and so I called the LV branch in Singapore where the wallet was purchased and they sent me a copy fairly quickly.

OP, I would call the branch in Paris where you purchased your bags and they should be happy/willing to assist you - at least that was my experience.

To him its either fakes which should not be allowed to enter our alp-locked country or they are real and taxes, fees and charges have not been assessed. No difference to him, the law must be applied.

Except they have told OP that they suspect bags are fake and shall be destroyed. Nothing to do with duties/MwSt.

If they conclude that your bags are fakes, they do, indeed, have the right to destroy them.

Here's some information from the Swiss Federal Customs Administration:

It is strictly prohibited to import into or export from Swiss customs territory counterfeited trademarks and counterfeited designs. This also applies to tourist traffic goods for personal use which are imported, exported or are in transit. Counterfeits may be confiscated and destroyed when crossing the border. It's thereby not important whether these goods are new or already used.

I've not heard of that, before now. I'd be very surprised if the Swiss Customs officials would be the ones to initiate any such check with the owners/ distributors/ sellers/ lawyers of brand labelled goods.

That made sense to me. Have you had any success in obtaining copies of the purchse receipts, from the shop you went to, in Paris?

Did the Customs officials give you a deadline by which you should bring them your proof, and after which, if they don't receive it from you, they will go ahead and destroy the bags? If they did set a deadline, and if you have reason to believe that you won't be able to make it (e.g. you're still waiting for info from the shop in Paris), then I recommend that you write to them (on paper, in a registered letter, including photocopies of all the documents they gave you, incl. reference numbers, etc.) to tell them that you have initiated contact with the brand shop/ lawyer, and are waiting for an answer, and to please grant you an extention of the limited period.

I am happy to provide them the receipts if they request. However, the brand lawyer did not follow up it at all.

The first time I contacted the lawyer, I told him those items are real. I called him as he didnít reply emails. He said he saw my emails and he will ask the brand to check the items. No extra fee will be incurred if those are real. I am happy and he said he will reply my email to black and white mention it. However, I didnít receive any of his emails.

Few days later, I received a bill about the document handling fee from the law firm. I sent email again about the reason of this fee and asked about the checking. I sent few emails and he didnít reply one of them. I called to the firm and every time they reply he will reply ďtodayĒ and tell me not to call as they donít rely on phone conversation.

There is a deadline to handle the parcel. I am really worried. What shall I do and where could I complain about it?

It seems to me that providing the customs officials with the receipts would be the quickest, most straightforward way to procede.

Earlier, you said you didn't have the receipts. LuganoPirate then recommended that you ask the shop where you bought them. Did you? Was that shop able to look you up in their records and supply you with a copy of the proof of purchase? If not, why not?
