B-EC permit for UK citizen and non-EU wife

Dear Friends,

I am relocating to Switzerland from UK and have a few simple questions. I did try and dig into the forums to get answers but could not manage to get all the info needed.

1. Swiss B(EC) permit: I know I need to take my passport & employment contract to the canton. Do I need to take any other filled in form/document? If yes, can I know the link details? Also, how long is the processing time for the permit? Can I start my employment before the permit arrives?

2. My wife is non EU citizen but has UK permanent residence visa. Can she file for her permit alongwith me in Zurich canton? Or, does she need to wait for my permit and then file for her permit in Swiss embassy in London?

I have found this forum enormously useful. So, thanks a lot in advance for your replies.

I went through the same process as you but in Neuchatel.

1. You don't need to fill any form out beforehand. It took 2 weeks for the permit to come

2. I had to wait until my permit arrived and then my wife went to the Swiss embassy in london to apply for a spousal visa. This can take upto 12 weeks to arrive. I think it took 8 weeks for my wife's to arrive. This is assuming your wife doesn't have permission to travel to Switzerland without a visa.

It would be advisable, if your wife is eligible, to apply for British citizenship asap! You can do an advanced checked service whereby you don't need to send any documents so can still travel.

Take your marriage certificate and your wifes documents to the local town hall when applying for your permit assuming the company employing you has not applied for your permit. Your wife has a right to a permit as long as you are married no matter where she is from unless she is prohibited entry into Schengen from any member state. (UK is not a schengen member)

Thanks Richard, I can try that. Not heard of this from anyone else though but it can really help me if this can happen.

She has an existing Schengen Visa valid for a year. I hope she still is able to enter the country on that while her permit is processed.

Hi Porch19999,

Thanks for the reply.

No my wife has been a permanent resident only for last 18 months and she needs atleast 3 years.

But, she has an existing Schengen Visa valid for a year. I hope she still is able to enter the country on that while her permit is processed (assuming that she does not need to surrender her passport to Swiss embassy in London)?

The amount of time that she has indefinite leave to remain in the country is academic...as long as she has it.

She just needs to have been resident in the country for three years since she came into the country to live.

Yes you can work before your permit arrives. Since you are EU, getting the permit is just a formality.

She has been a resident in country for 20 months in total only

Also, is there any place I can find the list/addresses of all the local communes (gemeinde) in Zurich?

It says on the website that she can't travel to switzerland while her visa is being processed IIRC.

All the info is there. There wasn't any charge for the visa when my wife did it though.

You need to separate the permit and the visa in your mind. Visa will get your wife into the country, the permit will let her stay.

The process is this:

You come into switzerland and apply for your permit

You wait for your permit.

Once you have received this your wife can apply for a joining spouse visa.


You may be able to do this without you permit because you will get a letter confirming you permit when you apply. This depends on the person at the Swiss Embassy in London.

You may be able to allow your wife to come into Switzerland on her current schengan visa and apply from the Swiss side. This depends who you get at the greimade in Zurich though, but I've read of people doing this on this forum

It says "Please note that the applicant will not be granted a tourist/visitor’s visa while the above application (with 3 forms) is being processed by the competent Swiss authorities."

Which means Swiss embassy will not give her a new Schengen but she already has a Valid Schengen that she has been travelling in Europe on.

You can definitely do it all from here. As long as one of you is EU the other is treated as EU for the purpopse of the permit. The only restriction being a visa to enter. But seeing as you have a schengen visa this is then valid for Switzerland. In the worst case your wife might and it is a big might need to travel to Stuttgart or wherever the next consulate is to get her permit documents submitted but this definitely should not be the case. Again as long as you are an EU citizen this is a gimmee.

When I (or we both) go to local commune to file for our B permits, do we need to submit our passports to the commune as well until the permit comes?

As was said above, your wife has entry permit so you both go together to the commune to apply for the B permit. No one will take your passports. You keep them. And there is no need to go to the the UK consulate.

I tried to apply for a tourist visa to bypass the long wait for a joining spouse visa but they where having none of it.

They noticed how long the stay was for and when I told them why they said that I'm applying for the wrong visa.

When my HR called the canton they said that I had to apply from the UK side as well.

It was all a big farce and waste of time and money (she had to go from Scotland to london to apply for the visa).

But it all depends on the canton because spousal reunification is decided on the cantonal and not federal level IIRC.
