(what if:) Work permit renewal failure - Who is responsible?

Hi

I have a situation to discuss. I ma on a unlimited contract with a Swiss Company and already having 2nd L permit. What happens when my permit is not renewed; who will be responsible for it. B'coz then i have to leave the country immediately and the contract b/w me and company will end so are the liable to pay me the salary for the notice period or not.

It is in the interests of the Swiss Company employing you to apply through the Canton for a B Permit.
The company I work for used to get L Permits for sub contractors initially (especially non -EU citizens).
If they liked the guy the next permit was a B Permit, if not it was another L Permit or a worse, contract termination.

So if there are chances of contract termination; is the company liable to pay me the contract termination money.

Check your contract?

I think you'll find your work isn't responsible for your failure to get a work permit though

But in the case of the OP it would be the employer's failure .

You are probably right though, there is probably a clause that states in the case of a work permit reject all bets are off.
