Grace Period of expired permit

the office applied for my husbands permit B and it was denied so as a result we need to leave Geneva, but the process of relocation and handover of job is taking a long time. Our permit expired at 31.12.2010 and we are now concerned about us being labeled at the immigration as over staying in here and we dont want it to happen. so how many days before we are tag like this. or how many days we are still staying legally after the permit expires.

please any information is valued.

The authorities are usually quite reasonable about this. In similar cases 3 months has not been a problem.

I would be a little concerned over "handover of job is taking a long time" as once the permit expires working may be illegal - it could be that the company has cleared this with the authorities but I would check this if I were you.

Thank you for replying. yes you are right he's not suppose to be working anymore as he doesn't have permit anymore and we have told them this.

as for relocation finally they will start packing by Tuesday and hopefully to be out here by the end of the month.

Oh well we had fun while it lasts...

WHy was it denied? The first time I worked in Switzerland, I couldn't get a B permit either - it had something to do with the annual quota of B permits having all been allocated. HOwever, in leui of that, I was able to get something else to carry me through while I worked. My understanding was that I would have got a B permit at the start of the next year. Perhaps something like this is possible in your husband's case?

Lotavel,

Sorry to hear about your permit situation. Speaking from experience, depending on your nationality, make sure that you have the legal right to be in the Schengen Area (and not just Switzerland).

As a non-EU national, I had enormous trouble at the Frankfurt checkpoint out of the Schengen area, even though I was traveling with a permit that had expired only six days ago and had the necessary paperwork from my former employer confirming that I was departing Switzerland. I was treated as an illegal immigrant and banned from Germany on the grounds of me not having a legal right to be in the Schengen Area - regardless of what the Swiss thought about me staying in Switzerland.

You're fine as an EU national, I guess - but if you're non-EU and traveling back home outside the Schengen Area, you can encounter enormous issues when you attempt to leave the Area. If this is your case, I would check with the authorities on what you're supposed to do in this situation.
