Residency Certificate US Citizen

Hi, I'm a US citizen and my fiance is a Swiss citizen living in Bern. I'm in Switzerland on a tourist visa trying to get everything in order so that we can get married here. As many of you know, the swiss government asks for a certificate of residency in order to proceed with filing marriage documents. I have called the local civil office trying to figure out what could be used for this document since US citizens don't have an equivalent that I know of, but no one seems to be able to tell me anything.

Does anyone know what US document will work as proof of residency? I have done a fair bit of searching on the forum and haven't found what I'm looking for. If I've missed it, please let me know where to look.

The rules on marrying in CH changed as of Jan. 2011. After this date, the partners have to be 'legally' living in CH. As a tourist, I don't believe you qualify. You would have had to enter with appropriate paperwork and registered in the commune where you live. Seems as that is not the case. Search this forum for fiance visa, that may be an option, but most likely you will have to leave CH and enter legitimately.

Hi JK,

I'm guessing that you are asking what are the US documents that you can use in CH to demonstrate that you are a residence of the US. Right?

If yes then, as the name suggests, the documents that you require need to show your proof of residence in the US. To demonstrate that, you can use any documents such as these which have your name on them:

1) Drivers License (in some cases). If you are small town guy then you can get a letter from the DMV stating that you live and drive in the US.

2) Documents to any property that you own in the US. Even property with a mortgages on it will do.

3) Any letters from your bank in the US which show the account(s) that you own and operate with them. It should show frequent transaction activity with them.

4) Any bills such as Rent, Electric, Heating, Telephone etc..

5) Letter from your employer or Pay stubs from work etc..

Wouldn't a passport do the trick? It's the most official identifying document the US produces. You can look up the Consulate for your state here. Then contact the Consulate to find out what you need to do in order to proceed. The Swiss Consulate I worked with before moving over was extremely helpful and prompt! Just keep in mind that their phone hours are very limited (one or two hours per day).

Thanks for your responses. I am aware of the change in law, but it remains to be seen how the swiss authorities will deal with the situation.

I went to the Zivilstandesamt yesterday and showed them the documents I have, which are my passport, a new copy of my birth certificate, and a sworn affidavit that I am fit to marry (from the US embassy here in bern). The sworn affidavit shows my civil status and my current address in the US. The woman at the Zivilstandesamt said that the documents I have should be all I need. She also told me that they need to take my original passport while doing their background check on me. She also told me that it might be possible to get an extension of my tourist visa so that I could stay while they were doing the check, but that I will have to check when the papers are filed.

I then went to the Einwohnerdienste with my fiance today and they told me that I needed to have an official marriage date from the Zivilstandesamt before I could ask for an extension of my visa. They were not sure if this was possible, but they said that if I got an official marriage date that wasn't too far beyond the end of my tourist visa, that I could probably get an extension.

So basically, I don't really know anything concrete at this point. I'll keep updating the status so that people can share in the information as I get it.

In case anyone is curious about the status of this one, here goes...

I am now happily married and am allowed to stay in switzerland!

About a month ago, my wife called the zivilstandsamt in bern. She explained that I was here on a tourist visa and that it expired in mid april. The wonderfully friendly woman at the zivilstandsamt said that we could get married before that if we wanted to. She scheduled a meeting for us for mid march to review our documents. In the mean time we had to provide them with my passport, a copy of my birth certificate (issued within the last 6 months), and the sworn affidavit that I was fit to be married that I got from the US embassy in Bern. This document had my civil status and my home address in the US listed on it, and this was sufficient for my "proof of residency".

They reviewed the documents with us about 2 weeks after we submitted them and approved our wedding date. We got married a few days ago.

Just yesterday we then went to Einwohnerdienste and showed them our marriage certificate, my passport, and my wife's rent contract for her apartment. They approved my B permit, and I will be getting it in a week.

As far as the changes to the laws that went into effect in Jan 2011, I asked the woman at zivilstandsamt, and basically all she told me was that "you cannot get married in switzerland if you're here illegally. that's the change to the law". I don't know what that means, but I'm just relaying what she said.

I hope this information helps someone out there!
