EU tourist about to expire... waiting for permit

Hi,

This is a great forum but unfortunately I cant see the answer I need. I have been looking round a load of documentation but keep getting very confused!!

I am EU and have a B permit as I have a job here. My boyfriend moved with me and we have applied for a B permit without activities for him here(he hopes to change this once he has found a job). However it may take 6-8 weeks to arrive (if approved) and then during that time, his 3 months that you are allowed as an EU visitor expires. (the week before the 6 weeks is up)

Does anyone know how long you have to leave switzerland in order to come back and stay another 3 months? I read about schengen you could only do 90 days in a six month period but we arent schengen....we are EU citizens.

Id really appreciate some help as were starting to panic and consider having an overnight bag at the door in case the police come to escort him to the airport!

I honestly don't think you have anything to worry about. My 3 months expired and I was stopped at the airport and asked my intentions on my way back into Switzerland. I explained that I was waiting for my student visa to arrive and was waved through.

My visa has expired a couple times now (am currently living for over a month without a permit in hand but it's on the way) and nothing has been said. No night time raids to deport me etc. A week really isn't a long time, EU citizens seem to get a lot of leeway.

If your worried though your best bet would be to go into the immigration offices and talk to them about it

Thanks thats such a relief...

however, he did register with the town hall as being here.... they had mixed up and thought we were married and his name was on the housing contract I had given them...hence why they realised he was here in the first place... will they not notice? or will they just not care?

I think well go and ask anyway!

This is just from my experience in Fribourg but here they just don't seem to care for such short periods of time. I honestly doubt that they will care that a week has passed over the allowed tourist visa time. They may notice however and a note be made to check up on it.

When I went to to the immigration office in February, two weeks after my permit had expired (naughty me), they knew who I was almost instantly but said nothing more about it. That could also have been because I had sent them an email 2 weeks before explaining what I was hoping to do and asking questions, I don't know.

As I said before, to fully put your mind at ease, just send them an email or talk to them. If they are anything like how they are in Fribourg then they will be very friendly and generally understanding. Especially in your case where you are waiting for the permit.
