Non EU, dependent B permit, self employment/consultant question

Hi everyone,

I have a 2 part question regarding my abilities to be self-employed here in Switzerland. So first the details as suggested in the subject line: non EU, I am on a short term B permit for family reunification with 'acitivite' in Geneva canton. I have a consulting company in Australia. I have been offered a 3 month consulting contract for an NGO here in Geneva.

1) Can I just work through my consulting company in Australia or are there some legal and tax implications because I am a resident in Switzerland and actually conducting the work in Switzerland? The contracts would be drawn up with the Australian company and not involve any Swiss mention, and indeed the money will go directly into the company accounts in Australia.

2) The Swiss self-employed option. Can I be self employed on my specific permit? I shake all over when I think about the possible paperwork and time involved in becoming 'self employed' over here - is this an easy process?

This offer has come up un-expectedly and I am un-prepared for it as I never intended to act as a consultant here. Obviously I need to act quickly and applying for self employment status here might not be feasible, especially considering this may only be a one time gig and not a long term employment option for me - I doubt I could convince the canton of my my financial viability and income stream etc. that would show I wouldn't be a burden on the state.

Any help, insight and advice to the above questions would be greatly appreciated.

Sorry I don't have a more complete answer for you, but I do know one thing - yes, you can be self-employed. What that involves, I only know the vaguest of ideas.

The NGO has a presence in Geneva so leave them to sort it out .

Haha yeah, I already tried to play that card, but as you can imagine the beauty of using consultants is they don't have to concern themselves with my legailities, just their own. They have pretty much intimated that will they sign a contract with me assuming I am above board and taking care of all my responsibilities, whether they be Swiss, Australian or from Middle Earth.

I'm not really interested in the 'self employed' option to be honest, way to much paperwork and ongoing hassles for a one off job. I intend to use the Australian company for the contract but just have the nagging concern that because I am a Swiss resident and in fact completing the work in Geneva that I have some tax and/or legal obligations.

Incorrect - they have a duty to ensure all internal AND external workers have the right to work in Switzerland.

You have obligations for tax and social security payments. You must be employed by a company with a Swiss presence.

Your best option would be to use an umbrella company in Switzerland - there have been a few recommendations on the forum.
