Non-EU Family Reunion Visa - Where to get Haye Apostille?

Hi there,

This is my first post here and I am asking for help about the family reunion visa for my wife. According to Google I supposed the question have not been asked before.

I made the application several month ago. Last week the OCP finally send me a letter. It asked me for the document named "L'apostille de la convention de la Haye (a reclamer aupres de votre Consulat en Suisse)" and "Le sceau du Ministere des affaires etrangeres, ainsi que la legalisation par l'Ambassade Suisse". I am really confused about the French. What are these document exactly and how can I obtain them? I remember we already submitted marriage certificate legalized by the Ministry of Foreign Affairs. Thanks.

The 'Simple' search on EF 'Family Reunion' gives six or seven Threads on the subject, though I admit they don't answer your question.
Your text, put into Google translate, gives:

The certificate of the Hague Convention (a claim with your Consulate in Switzerland)" and "The seal of the Ministry of Foreign Affairs and legalization by the Embassy of Switzerland".

So it looks to me as if you need to get in touch with your Consulate here. At least you could ask them about it, as they should know.

Thanks longbyt. I also did that translation but just confused about the papers and the procedures, and where do I start with. I suppose lots of people are experienced with these documents. Good suggestions though I think I just have to contact the Embassy here first. Enjoy the weekend!

They are not asking for more documents! They are telling you that the documents you presented need to have "the seal of apostille".

You can read all about it here on wiki as we EF'ers like to quote wiki.

Basically is it an internationally recognized stamp that affirms the documents you are submitting are legal.

You will need to go the Chancellery in the old town to get it apostilled, it costs around 30 chf but has a Swiss notary notarized it?

Yes miniMia they are not asking for documents. The problem is that the marriage certificate we submitted is one-off. The OCP didn't mail them back to me. I guess we will have to get our marriage re-nortarized, then get the seal of Ministry of Foreign Affairs and legalization by the Embassy of Swizerland in my home country. After that, I have to get the stamped document mailed to Switzerland, and then get the Apostille of Hague on this legalized certificate. Am I right? That would probably take another month

In Ticino, the 'Apostilla' is only to be obtained in Bellinzona (the capital), don't know how it works in other cantons, but I would expect the same.

Basically, it's an affirmation of the notary's signature.

I get it when I lend my car to family. I normally do it myself, but sometimes have had a lawyer friend do it for me (he also does the notarization). When I do it myself, I have the document notarized by my coomune, then go to Bellinzona, costs about CHF 25 as I recall.

Oh, and you need to do it in the canton where it was notarized, as basically they look up the notary's signature in a filofax, and compare it to the one on the document.

Ask them to give back your documents to you can get the seal on them. The seal has to come from your home country. Switzerland can not put the seal of the apositle on documents issued by another country.

You'll have to follow what ever procedures are set out by your home country for the various documents.

Not quite true. It has to be done in the same country the signature on the document was notarized. It is simply to confirm the validity of the notarization.

A update to this post. For the whole last month we re-notarized our marriage (because the OCP didn't send back this document which was going to expire in about ten days), got the the seal of the Ministry of Foreign Affairs, sent this document to the Embassy of Switzerland to get it legalized. We were informed that this document will be sent to Switzerland directly and we cannot take it back. So last week I wrote a letter to OCP to tell them if they need the Apostille they have to mail it back to me and get it apostilled. Now we are just waiting.

It has already been more than six months since we submit the visa application. Is this normal? Or just some little bastard playing with us? I feel completely helpless facing these government guys. In the worst case I hope we can get this visa in the next two months.

So currently where are you? Geneva? If not, please update your location. It really help when people try to help you.

Yes I have been in Geneva. Actually my wife instead of "we" went through all the procedures for the last month.

My wife is in China. Because China is not part of the Heye Convention, so we may only (but I am not sure) get the Apostille in the Chinese Embassy here in Switzerland.

Is your wife dealing with the Swiss Embassy in China? I would imagine they should know what to do if China is not part of the Hague Convention.

If I were you, I'd make a new thread specifying Family Reunification for Chinese citizen in the title. There are others from China on the forum.

If I were you, I'd make a new thread specifying Family Reunification for Chinese citizen in the title. There are others from China on the forum.
The embassies either Swiss side or Chinese side does not help much. They usually just send documents rather than handle cases. Thanks for the advice anyway. I may start a new thread after I receive any news from the OCP.
