is it possible for an EU citizen to have UK + Swiss work permits?

Dear Forum,

We've gotten ourselves into a very complicated situation that we're trying to resolve. I'm a non-EU citizen in Switzerland with an EU spouse, on a B permit. I have the right to work in CH, but for my career it's much easier for me to find a job in the UK. I just landed a really great job that I could potentially do by communting into the UK once a week. The problem is that it's very difficult for the company in the UK to issue me a visa without my husband coming there and taking up residency and sponsoring me with a Residency card. Does anyone know if it would be possible for him to have an official residency and right to work in both countries, so that he could keep working in Switzerland and I could work in the UK? He has business contacts in the UK and would actually be able to do some work there occassionally. But we're afraid he would lose his Swiss C permit if he established residency in the UK.

Anyone brave enough to answer?

These are two countries, why cannot he live in both places? He has to pay taxes twice, but otherwise where is the problem?

The work permits are for UK and for Switzerland, there is no EU work permit.

Thanks for the advice. I just wonder if he decides to "exercise treaty rights" in the UK that would count as leaving Switzerland for more than 6 months (not permitted according to the C permit), even if he actually DOESN'T physically leave Switzerland for more than 6 months.

It is possible to live in two places at the same time. Just be careful on how this will impact your taxes. You might get a big shock.

When use is made of the double tax treaty ?

When the social security authorities get involved? Since the bilateral agreements they do communicate you know .

He already has the right to work in both countries. There is nothing to stop him taking up residence in the UK and he won't lose the C permit unless he contravenes the residency requirements. As noted in the thread tax will be the biggest issue but I would add social security (NI) payments into the mix.

Why not talk it through with the authorities on both sides?
