As asylum seeker and now rejected.

I was asylum seeker with N ausweis and after was rejected. i have lived in aargau for 2years as illegal,now my girlfriend is pregnant. without any permit to stay or work. i want to work and support my child and the mother,how can get a permit to do all this.my head is so hot with a lot of worries from the pregnancy and my situation. some body pls help me.

This is not news to you I am sure, that claimants from Nigeria are considered economic migrants by the BfM. Notwithstanding that:

Did you appeal within the 30 day deadline ?

Does your GF / mother of your unborn child have a permit to reside in CH ?

I would say this cuts down your chances of staying a little.

I wanted to re appeal but the lady in the caritas office that handled my appointment advice me not do so.

My GF is a swiss national.

My kanton is Aargau.

I guess she must have firm grounds that anything under the Refugee Convention is implausible insofar as your claim is concerned.

Still, the lawyers are well attuned to finding a solution around your civil status. I'd say approach them and see what they have to say despite the new laws that prohibit your marriage unless you first have a valid permit / visa.

This is one of the few examples where this may not work.

As he's already been rejected and living here anyway, they may well refuse the "family unification" right and deny any permit.

He may well be unable to travel without being detected as he may not have valid travel documents. Claimants surrender their national passports in exchange for an N permit ( temporary, pending resolving their claims for asylum ). To get back one's national travel documents, the BfM will have to arrange for a deportation, now re-introduced after a temporary suspension owing to the death at Kloten airport in an unsuccessful deportation to Nigeria.

Swissinfo EN - Church to Monitor Deportation flights ( church's observations may be censored by the government - can watch but cannot talk )

Hi,

The best people to help probably are
Sans Papiers - Aargau

As a previous poster said, it will get difficult to stay, as to get married you have to be legal in CH. But there have always been made exceptions for sans papiers in difficult circumstances, so
wish you good luck...and congrats to the baby!
