C Permit due to expire - question

Hi all

was just wondering if any of you have more info regarding the following: I have already emailed the Gemeinde a few weeks ago but have not received any replies so far, anyway the story goes:

I was born and grew up in Switzerland holding a C Permit (from Italian backgrounds both parents and granparents with C Permit).
My sister got granted the Swiss Citizenship after appying for it.

I been living abroad for 1,5 year and my C Permit got extended for 2 years.

Question one: I know it's extendable for 4 years but when applying for it do they grant it automatically or do they want a specific reason (work abroad, study, ecc??)

After the 4 years have passed the C Permit expires and here comes the big question: if I would happen to move back to Switzerland, would they grant me the C Permit again? since I was born and grew up there and did all my studies in Switz (not sure that is relevant)? also I never lived anywhere else other than Switzerland as all my family is there.
What would the procedure be? would this be looked into as an individual case?

The Auslandsamt didn't really know they said I had to get in touch with the Gemeinde so I did.

Just thought I drop a line and see if anybody here has or has had a similar situation.

My daughter was born in Bern, lived here all her life, had a 'C' permit. At age 15 her mother took her to UK, without applying for a sojourn!

After just under 2 years she came back for an apprenticeship and was given a 'B' permit. She has been back now 3 years and still has a 'B' permit. She expects to receive the 'C' again in May 2013.

Thanks!

Can I ask do you also hold a C Permit or are you a Swiss citizen?
I wonder if that makes a difference?

Surley if C Permit holder are born in Switzerland and their families live there and have lived there all their life it counts as "family reunion" if that makes sense to you?

My son and I have had a 'C' permit since October 1994. All three of us are British. As I explained, my daughter, born April 1991, was re-issued with a 'B' in May 2008 for studying / working as an apprentice Kauffrau. She is now looking for her first career job.

Assuming you have no criminal record, there really isn't a great deal of difference between an EU national 'B' permit and a 'C' permit: with both you can stay here if your record is clean.

I extended my C permit for 2 years and then had to extend it again for another two years. We had to provide a letter from my husband's work and tell them that we were planning to go back.

If you don't extend the C permit as an EU citizen you will get a B permit.

Thanks, sure that makes sense.

Although still a bit unclear since the C Permit is only re-newable for 4 years, after that time one will lose it.
Also this means for the whole extension period you still have to pay for the Krankenkasse.

Let's assume after 10 years away from Switz you decide to go back, you have no job, no Krankenkasse, you have to set yourself up again.

What B Permit will you be granted? the "6 months tourist Permit" or the "5 years valid B Permit" who will then turned into a C again?

Not sure if I make sense...

No, you do not pay any health insurance if you are not living in Switzerland.

My daughter received the "5 years valid B Permit" for 12 months periods.

Thanks for all the info.

I am still paying for my Krankenkasse. I could not opt out of it if I wanted to keep my C Permit. I could block it for a period of 12 months but after I had to make a decision. So I kept it for now. In order to keep the residence.

Well, if you are still resident in Switzerland then yes you have to keep paying health insurance. So then you don't have to extend your permit, you have to renew your permit. I think you'll need to do that in person or at least have an official address in Switzerland which is considered your resident address for them to send you the new permit.

I do not pay health insurance because I'm no longer resident in Switzerland.

If you lose your C permit, you will most likely get a 5 year B which then turns into a C. You could get a 6 month L permit in order to give you time to find a job. But that is dependent on your circumstances.
