Employer won't give work permit to frontalier

Hi all, my friend and I had this long open-ended discussion about his work situation so I thought I'd just ask for your help.

Basically he's French and found a job in Geneva for a startup co. He got a contract and everything but it was never made official. The employer promised him a work permit and official employment but after 5 months of working there, still no permit nor official contract as the employer told him they cannot afford it. To make matter worse, the company didnt take off well and they basically owe him a month's salary now. He has since quit his job and wants to get paid.

What can he do, where can he go? What are his rights as a frontalier?

This has little to do with permits as the employer did not need to sponser the French guy. He will need to persue the perceived debt in the same way as any other.

Well that's a relief! His main concerns are:

- Will he get in trouble for not declaring his income right away? (as this was supposed to be done by the employer)
- Will he get in trouble for having worked in Switzerland without the appropriate frontalier permit? (also supposed to be from employer)

No, as it was a few weeks he needed nothing anyway - technically should have registered but it won't matter a jot.

And no, any permit was not supposed to be from the employer

Yes, she said he worked for 5 months, but didn't get paid for the LAST month!

oops.

Still won't be any trouble and anyhoo he lives in France so it's to the French he'd need to declare his income.

On the contrary, he can't get a permit on his own unless through the employer and with a valid job contract.

And he was not going to declare his income in France since he is supposed to have been registered in the Swiss system (tax, chomage, insurance, etc.)
