Non-EU/EU married couple - B permit based on Non-EU's Employment?

Hi all,

Here's one for the most technical minded of you:

I'm non-EU, wifey is EU(UK). I telecommute with my job in US. Question is, will we be able to get the 5 year B permit from the fact that I'm technically employed?

I ask because it seems like a dependency issue i.e. my status depends on wife being EU but me, non-EU, having a job.

Thanks for those who can solve the riddle.
