Permit Extension Possible

I am a non EU (American) living in Swiss since a couple of years. Lived in Zurich and now working in Bern.

I am afraid, I will be let go soon, and my permit will expire in November. My job ends October. My employers wont extend my permit. I am qualified enough and experience enough to find another job. However, I need time.

I was told by one of my colleague that there is RAV in Bern which provides unemployment benefits up to 70 % and also extend the permit for a year if I have clear background, like no loans no unpaid bills etc. I have a clean record.

I got an open permit when I got mine and then it was transferred to my employer. And now it says.

ART DES TITLES : aufenthaltsbewilligung (B)

ANMERKUNGEN: mit erwerbstatigkeit

and at the end it says

selbst. erwerbstatigkeit ist bewilligungspflichtig

thought I am able to find what this is translated in to english. I just want to know if

a) Will my permit be extended for another year until November 2012, and revert back to open status, so that I can get another job

b) Will i get dole until I live here and find another job.

Were you contracted for a period ending in October or were you employed normally but now have a termination date in October?

I was a full time employee .... and all of a sudden there are lots of '' corporate restructure '' Initially plan was to extend my permit on a yearly basis, as it is for any normal job for any B work permit holder.

In which case you are entitled to RAV unemployment benefits as you describe and your permit should be renewed.

Not sure what you mean by this - if you had an "open" permit it cannot be subsequently attached to an employer. Someone has been telling you porkies .

Thanks Swissbob.

My company HR said that I had an ''open permit '' and hence it is easier to give me the job, since it can be easily transferred to the company name.

However, I am getting vibes from your comment that, an 'Open Permit is always an open permit and not restricted to any employeer. It also doesnt say my company's name anywhere on my permit, so it makes sense now.

If that is the case, and it is an Open Permit, and if my permit is extended, I might not have to go through the B permit quota thing and be a bit less of a trouble to get a job then eh!!!

For Non-EU, once you go to the B permit you should not have major drama with renewals. However, if your job is going to finish then they should give you the right notice period and with that information you can go straight to the RAV and discuss your options...

at least, that's how I understand it to be...

Quotas won't come into play again - renewal will depend on you being either employer or registered with the RAV - you can get your permit renewed whilst unemployed - but of course it would be better to get looking for something now...to avoid the heartache.

I moved employers after my dependent B was approved (had a dependent L tied to my previous employer)... it was very straightforward - a couple of phone calls to the 'arbeitsamt' (work authorities) and some form that needed to be stamped - and the name of my new employer was added to the renewal form...but my permit doesn't have the employer's name on it anymore because it's not 'tied' to them...

edited to add: all the paperwork/phone calls to switch employer were done by my new employer, not by me... !

I even have a letter issued to my employer which they very helpfully gave me a copy of - which states specifically that I have a permit that allows me to freely work in Switzerland! - pretty helpful for clarifying my status - not that I have any intention of changing jobs any time soon...

Thats a relief then, and yeah I have started applying for job since a week already, the sooner the better, given the speed of the whole selection process in Swiss.

My case was similar, I never had my employeer's name on my Permit, initially I worked for Swisscom, and when I decided to join my current company, they said, YES INDEED YOUR PERMIT IS AN OPEN ONE, and it wont be a problem to give you the job. So I suppose once you are in the OPEN category, you never go back to being stuck to one employeer. I am still on OPEN status and wont be a part of that quota thing anymore,which created hassel a couple of years back.

May be I will ask my next employeer to give me such letter and info, just have to be careful that they dont interpret that as I am going to leave soon.
