Upgrading L Permit to B Permit

Hi,
I
arrived in Zurich with my family 10 months ago on a limitedtime contract. As a non-EU we got L Permits. Now my contract was changed to anindefinite contract.
I have approached my employer asking to apply for a BPermit. I was notified that the chances to obtain a B permit starting my secondyear here are very low since I am in a quota of L Permits. Therefore, I wasnotified, that I have to complete 24 months with an L Permit before I canobtain a B one.
Has anyone had some experience with this kind of issue? Ithere a way of obtaining the B permit starting my second year after all?
Also, assuming that I will be granted again with an Lpermit, my wife wants to start working also. Is she allowed to search for ajob? How can she obtain a work permit for herself also?

HI,
I have been in the same situation as a non EU member, I had a work contract (L-permit) for two years where after I needed to leave Swiss, The only way I could return is by having a B permit..with the help of my former employer they could help in getting the B but this was also limited to 3years and a lot of paper work. It seems that we obtained the B by providing evidence that the kind of work I was doing was not suitable for candidates applying in Swiss and from EU countries... my last year is nearly ending and we are again trying to get entry.. It seems like a lottery system ... As for your wife, I do not know how she can go about, as I was not married coming to Swiss. Best of luck...

Unfortunately this is an area where the authorities are very visible at the moment. An employer brings someone in on a short term contract and then changes it to permanent to beat the quota system.

Not quite. The maximum term of a normal L permit is 24 months after which the employer must apply for the change to a B permit. There is nothing to prevent an employer applying for this change earlier.

There is nothing preventing her from job seeking.

Just to add a 'positive' - I was in your situation - we were on L permits for 2 years, before getting the conversion to the B - it seems to be fairly common practice, for open work permits...

I was able to find an employer that could show evidence that the could not find anyone in Switzerland or the EU to do the job - they had the job advertised for over 12 months. The conversion only took about 4 weeks to approve.

However, the key is whether your wife has skills/qualifications that are unique enough to match a job where there are no suitable local applicants. In my case, I hold a university degree plus postgraduate course which was specific to the work, although the work itself is childcare, they needed an english mother-tongue, with specialisation in babies/toddlers, and my university degree was considered appropriate - and they truly have trouble finding anyone in Switzerland - partly also because it was a very small employer, not very 'attractive' for career progression, not highly paid work, although I was very happy working there and found it a great job!

If your wife has these sorts of qualifications, feel free to PM me...I'm happy to share my tips, and explain the pathways for getting foreign qualifications recognised (or not) locally...

Except the OP doesn't have an open permit .

There is a fairly important renewal process after the 2 years on the L. I wonder how long the original permit was issued for - sounds like it was 'pre-approved' for two years....

Thanks. I was indeed told that the chances to obtain a B Permit for the second year are low though I have a relatively senior position and an open end contract. However, they would not go an extra mile and save me the hustle...
From what you are saying it seems that I have no other choice but to wait another year...
