Urgent Advise needed.. !

Guys.. we've a situation here.. Would need expert advise..

One of my Indian friend, Indian passport and B permit holder is in US (NY) and was suppose to be back in Zurich today morning (30th Oct) but could not fly due to bad weather condition and possibly reach here tomorrow if everything falls on right place. His permit is expiring tomorrow (31st oct) and his prolongation is still in process (he's waiting for the card to get delivered), so my questions are..

1. Would he face any problem in getting in CH if he returns on the last day of valid permit?
2. What would if he can't get back tomorrow? Would he be deported back to India?
3. Can I or our Swiss friends, help him to get in?
4. Is there any way out?

Would appreciate any kind of information you've.. Please help !

He will be allowed in - best he carries his proof and confirmation of permit extension issued by his Gemeinde to show passport control.

Hi Jspret.. Thnaks for some info..

Unfortunately, he doesn't have any document because there is no such paper given by the authorities (the decision was pending 3 weeks back, when he left but the case was very positive that he'll get prolongation)... He went to immigration office before his visit to NY (maybe he predicted a possibility), but they said to visit the Swiss consulate in NY and they'll give Visa in a few hours, it's Sunday today and for sure consulate is closed. .. Stuck in difficult situation ..

Any other way out?

Strange as he will be arriving on a valid visa ( with a day left ). A confirmation is a piece of paper stamped by the Gemeinde or Migrationsamt stating that an application has been received for a residence permit renewal and is under process.

See Could I leave the country without the B permit card......

The Gemeinde issues a confirmation upon application ( I had it too as non-EU B ) after a fee has been paid ( it looks like a receipt ).

We were definitely issued a document from the authorities that said that our permit had been approved - it was issued to our employer several months prior to the expiry.

We also got a receipt from the Gemeinde when we lodged the papers for the permit renewal. As jrspet said, it was a reciept that showed that we had paid the lodgement fee...we filed it very carefully!

I would think that the Swiss immigration control will be able to see the application for the permit renewal in the system as well as the status of the application (approved/pending, etc).

I don't think this is the case as permits are issued by the canton and not federally (although are federally approved), the two streams are somewhat disconnected. Im still traveling on a permit that expired in June because I haven't gotten my new one yet, and not once has anyone said "oh we see you're pending/awaiting approval" etc. I just get lots of flack because I don't have the new one. Which is being controlled asap and might be here in 2 months :-S

Thanks to you all for suggestion, So in nutshell I think the invitation for the finger print in immigration office from the Kreisbüro would be the only document which can tell that renewal is in process, I guess I'm right?

No, as others said in this thread: you pay a fee for your permit renewal/application upon which you receive a receipt aka proof of permit in process.

Just for some people reading this post later...

Friend of mine entered Switzerland without any problems with a B-Permit two years expired and without Visa (you should deposit Permit when you leave..)

I think once you're in the system thats it....
But I have to admit, he was sweating blood on the border control...

Train the "Grüezi" it really helps going trough

I know its a bit OT and im happy your friend didnt have any problem, but why would he/she do that? was there a plan B in case the entrance was denied?

no, actually the worst PP in this world: Russian
Every Immigration Officers touches it as it would transmit the plaque.

They just checked it briefly (old paper-B-Permit), stopped for a moment on the expire date and thought: too many papers to file and made a waiver.

if this was a lucky day or not, take your guess.

to coconut:
The PP was full, no more free page for a visa, so no chance to apply. No chance to get a new one ether because not expired!!!! (and you think you have problems, right) You know the saying: No PP no work, no work no PP.
