| I have searched for a few hours and decided to ask this rather complicated family affair. Since the laws change - I am reading posts from 2008 and don't feel comfortable they still apply. For example now there is a CE permit for EU nationals? Not sure if this is valid for Poland.
I am Indian, Wife is Polish and child is American.
I have a job offer to work in Zurich and all the papers will be taken care of by the company, the response from the lawyers at this stage is they do not know what category they will apply under given that there are Quota's for Indians and don't know which one will be open / available. Start date is Jan 2012.
I am leaving my American Green Card process to move to Zurich for a very well paying job (did not make sense to complete the Green Card and pay taxes to the US).
The questions I have are below. Please Help !
1. Does it make sense to apply for a B permit for my wife (EU national) and I am her dependent ?
2. If yes what do we have to do ? Does she need a confirm job offer for this (we are trying to get her placed as well, but there is no offer)
3. Where can we find out if there is availability in 2011 for B permit for Indians ?
4. Is there a Quota for Polish? Once again does it make sense to travel being her dependent?
5. thinking ahead of C permit – is it better for us to apply under her, or does not matter | |

1. Your wife will not directly get a B Permit if she doesn't have a job offer. I think in the beginning , the best your wife can get is an EU - L (EU looking for job ), however as soon as she gets a permanent job, getting a B for her should not be difficult (since she is from EU)

3.Nowhere. You have to apply and the arbeitsamt/migrationsamt will let you know.
4. See 1 again. Poland is EU, so once she has a job offer, getting a B will not be a problem.
5.EU get C permit after 5 years. Non-EU generally have to wait for 10 years.
Another option : Become an EU i.e. get yourself a Polish passport (if possible) and then it's going to be a smooth ride for you.
