During the Work Permit application process...

Hi all,

Does anyone know if a non EU must leave the country during the WP application process? Or can one stay in Switzerland till it's approved (as long as it's within the 90 days as a tourist), then leave the country to obtain the permit, and then come back?

I'm getting mixed info and am a bit confused now...

Your question is a bit confusing.

Did you get a job while you were here as a tourist and now a WP application has been filed ? In this case, I think you are technically allowed to stay only until your 'tourist' visa is valid. You must go back and then come again after your WP arrives.

Exactly... but now I am hearing that you are not allowed to stay in the country while the WP is being processed even though I am a tourist and could be travelling anywhere in EU/Schengen (and not just being in Switzerland) as you don't get a stamp in your passport?

Technically you are supposed to leave the country during the process of any type of permit (work or family reunification), but as you are able to enter as a tourist, no one will stop you unless you tell them you are in the process of getting a permit. You do have to arrange to have your permit sent to a different country to pick up.

Bottom line, the rule is you leave, but even the embassy staff in Vancouver told us to say my husband was coming over as a tourist and they made the arrangements to send the permit to Munich for pick up so I don't think it's something they really care about as long as they don't have to deal with it at a customs declaration point (ie airport). And you state your entrance to the country in alignment with your permit when you register at the Gemeinde.

So officially you ARE supposed to leave the country....? Today I spoke to yet another non EU person who entered the country while the WP was still in process, the immigration at the airport mentioned that fact to them, and they just answered they are coming in a tourists, and will leave the country once it's approved to "pick up" the permit outside... Apparently they had no problem coming into CH....
