about residence status after divorce

Hello everybody. Here comes my story...

I have been working in Switzerland since 4.5 years ago and I met my wife here. And two years ago, I was married to my wife, who also works in Switzerland.

The sad thing is that although the life after marriage was great in the first year, in the second year due to some reasons we were having more and more problems. And just a few days ago, we made a difficult decision: it is better for both of us to return to the single state. We will divorce soon. It is sad but it is life.

Then I'm thinking about my residence after the divorce, since I am aware that as a non-EU national, there are much more restrictions on me.

My permit history: I started with 2~3 years non-EU L permit, then changed to EU-B after my marriage because my wife is Italian. My current EU-B permit's expiration date is in 2.5 years.
My work history: changed work twice, my current working contract finishes in 2 years.

What I want to know is that what will happen after the divorce. Do I have to leave the country immediately? or can I finish my current working contract anyway? Certainly I will not be able to hold my current EU permit any more because it is based on family regroupment. Do I have to notify my employer now because they will have to ask a new working permit for me?

Also, before I have to leave, if there are some benefits that I can ask?

Any idea, experience will be of a great help.

Thank you!

Re: about residence status after divorce

What citizenship do you hold ?

Have you tried asking your local community ?

It will take a long time to finalise the separation/divorce. I would think that you have at least until the length of the current permit to find out the answers to your question. I am quite sure you won't just lose your permit automatically as you were already in Switzerland and had your own residency status before you switched to the 'family regroupment' visa.

I would recommend you simply go to your local Gemeinde and ask those 'hypothetical' questions. And I would also suggest marriage/relationship counselling...if you haven't already done so.

Re: about residence status after divorce

It is really quite simple - one can stay in Switzerland as long as one is gainfully employed (or has enough finacial means to otherwise sustain oneself).

Divorces are irrelevant.
