c-permit when can i apply?

Hi, I am American, wife is Russian, we have been here 5 years and applied for C permit this year but were sent b-permits. What are the rules for someone in our situation for obtaining the c-permit? Can we dispute?

After 5 years on a B permit you can get a C permit IF you are EU national.

Other than that, it's longer wait (10 year perhaps? I don't know)

There is a "new" VINTA law that facilitates non EU citizen to gain C permit over 5 year B permit but it's not automatic, a lot of IF IF IF in the law.

Tapazoh, I'm also an American, (wife too) been here 5 years. I called the Migrationsamt in Zurich and they said we are now eligible for the C permit, but we have to show proof that we speak one of the national languages. We speak basic French and German having lived in Geneva and here, but nothing official. They said we will need to show the the Goethe certifcate for passing level A2.
So now they are sending us B permits again, but they said whenever we have the langauge certificate we can apply for C permits anytime now. Doesn't have to be in another year.
From my dealings with the Migrationsamt, I know you can challenge, but I don't know how and I don't think you will get very far.
