HELP! canadian citizen getting married to swiss citizen - fiance visa yes or no?

Hey guys

My fiance (canadian citizen) and me (swiss citizen) want to get married this year in November.
I called my civil office in Bülach (Zurich) the lady told me he has to get all the documents he needs in Canada and either bring it to the swiss embassy in Vancouver (where he lives right now) so they will proof it and send it to them OR bring the documents with him so we can bring them together to the civil office. She never heard anything about a "fiance visa". As he's canadian he can stay here for 3 month and we can get married within this time she said (which is what I thought as well).
So I sent an e-mail to the swiss embassy in Vancouver and asked again about what he needs to do (just to be sure). They told me he NEEDS to have a visa to get married with me in Switzerland and he MUST bring the documents to the embassy which costs 243CAD. I knew Vancouver is a rip-off city but I didn't know they're that sneaky!
So I sent another e-mail to the migration here in Zurich to ask the same questions again. Now they told me it would be the best way for him to get a visa just so he can stay longer than 3 month IF we couldn't get married within those 3 months, but they didn't say he HAS to have one.

So who's telling me the truth? I'm really annoyed about the incompetent authorities in Switzerland and in Canada!
Did anyone marry a canadian citizen here in Switzerland and can help me? I really really need some real experiences!

Technically the embassy is telling the truth that he will need a D visa. But sometimes the communes have been known to waive this requirement.

Thank you miniMia! So there's still a chance for him to marry me without a visa? I saw that it takes up to 4 month to get such a visa (of course nobody answered the question how long it will take) and as he will be here by November there is no 4 month for us to wait for such a visa?

Sorry - I wouldn't go on anything the embassy in Canada says.

I'm CDN, my husband is Swiss. He came over in Nov 2005 and I came over Dec 2005 just on my passport. We went to the embassy in Montreal and were told 10 different things by 10 different people.

When I arrived here we went to the gemeinde to register me (this was 3 weeks after i arrived, once we eatablished where we were going to live and had an apartment) and told them we intended to marry sometime in 2006 but did not have a date yet. The woman said no problem and we received a letter a few days later for me to pick up saying I could stay in Switzerland. I don't actually know what this was, fiancé visa? honestly have no clue, but it was really easy and no one gave us a hard time about anything. I think we paid around 75 CHF for this piece of paper.

Six months later we made the application to be married here, our paperwork was approved within 5 days and we had a date 3 weeks later, again no hassle.

We had such a hard time dealing with the embassy we decided to chance it and just come over as we knew I could stay for 90 days in any case.

Edit: the paperwork he will need is his passport, birth certificate (I was able to use my original one dated 1983) and a signed letter from the consulate (you can make an appt in Bern to get this) stating he has either 1) never been married and is who he says he is or 2) officially divorced (you will need to provide all of the documentation reflecting this) and he is who he says he is. I made an appt in Bern to get my paper, it took about 2 weeks to get the appointment, 5 mins and $50 to pick it up. Maybe this is what your Bülach contact is referring to

(I married my Canadian/Swiss wife in the US while on vacation)

No. I didn't say there was "no way". JanerMacP told her story above and you'll find a few other stories like hers on here.

But "technically" () the rules are that you need to enter the country with the appropriate visa. So if you ask the embassy, they are going to tell you the rules as they see them.

@JanerMacP - Thanks for telling me your story, that really helps! I never had a good feeling about what the embassy told us, so obviously my feeling was right. But you were getting married in 2006, the law changed in 2011 as far as I know to go against sham marriage whatsoever.. So I really hope nobody will put a spoke in our wheel

@st2lemans - haha oh well it's not that easy we already made the decision that we will marry here so..

@miniMia - ok crossing fingers I guess!

If anyone else got experiences with this, please let me know! I'm thankful for every story!

I have to say, I forgot about the law change thing! So when you look for other stories on here then check the dates.

But if you can get the commune where you are getting married to put that info in writing, I, personally, would take the risk. But that's just me!

Well my civil office said he can take the documents with him and we can get married within those 3 months (e-mail and on the phone). The migration office in zurich said (in the e-mail) it's he's choice if he's applying for the visa or not, but IF we couldn't get married within those 3 month there would be no way to extend his stay. Only the embassy in vancouver told me he needs to have a visa.

I am a Canadian citizen, who married my Swiss wife in 2007. It was a big paperwork process with notarized birth certificates, updated citizenship docs and approval of the geminde, that took more than 4 months and many interviews until approval and marriage in July 2007. To this day, six (6) years later, I simply have a "B" permit and do not expect more. I have worked to the maximum, paid our taxes and behaved myself. This is the Swiss way - still the best country in the world

Non-EU people married to Swiss citizens get a Swiss passport after 5 years.
Non-EU people (USA/Canada) NOT married to Swiss citizens get a C Permit after 5 years.

Are you sure you are doing everything allright

so did you get a visa or something to stay for more than 3month so you can get married?

we finally have all the papers now that we need so i hope it won't take another 4 months at the civil office to get married, crossing fingers!

They don't "get a passport" after 5 years. They can apply for citizenship. No one is obliged to do so and it's not automatic by any means.

C permit also, you must request it upon renewal.

There is no reason it should take that long. Once you gather all your paperwork they should give you dates for when you can get married. Have you checked the canton and commune websites? Those are really getting very up to date on lots of things. Particularly anything to do with the civil registry.

Which country in the world issues Pass to it's own citizens without an "application"/"request" ?

You think the gentleman would have got a B in the 6th year without "applying" for it !!!

The point being that citizenship is NOT automatic after 5 years, and can be denied. And you cannot request a passport until you have applied for and received citizenship, which can take several years after application.

This is probably different per canton/commune. If Montgomery hasn't got his C permit yet then he should specifically request it as renewal. I had to specifically request the C permit on my B renewal form.

Up until the 90s, it was automatic when a woman got married to a Swiss man she became a Swiss citizen.

I was just clarifying in case Montgomery was sitting back waiting for things to happpen. No need for all the sarcastic punctuation.
