Pension Fund Withdrawal (BVG)


I need some insight on the following situation :

I am in process of starting my own GmbH as a sole subscriber and employee.I wish to withdraw my pension to use the amount as a capital/working capital.I did had a mail corrospondence with my pension fund managing company and they reverted that I cannot withdraw my pension in case of GmbH but if I start a sole propritorship, they can allow me to withdraw.

Due to my permit renewal, (B permit-expired), I was advised by my lawyer that I stand a chance to get a permit in case I start a GmbH.

I need to know :

1. Is it correct that the pension withdrawal is allowed only in case of a propritorship firm and not for GmbH even though I would be the sole person in that?

2 I know that I can initially start a sole propriorship firm and than convert in GmbH to withdraw, but than the chane for getting my permit renewed is reduced .

Your inputs would be highly appreciated.
