Residency requirements for B permit

Hi,

As a EU citizen, I'm working in Switzerland for 4 years now, but I don't live here. I constantly travel, and until now I renewed every year my 120 day permit. When I'm in Switzerland, I stay in a hotel. I also pay all the taxes in Switzerland. I'd like to ask if I can apply for B permit, so I don't have to renew my 120 day permit every year, without having an address here?
I have some friends/collegues which address I could use for mailbox if required. Do you need to have a rental contract in this case?

Thank you in advance, Botond Szakacs.

Re: Residency requirements for B permit

Do you have a contract of employment with a Swiss employer? That would probably do the trick

Re: Residency requirements for B permit

If the OP is self employed, employed or self sufficient he would be entitled to a B permit if he has is main home here.

Re: Residency requirements for B permit

EU = no problem, just ask. Take along a tax return just in case they ask about supporting yourself.

Get a PO Box from the post.

Re: Residency requirements for B permit

I do have an employment contract with a Swiss employer. So a simple PO box is sufficient?

And for the real address to I need a rental contract? Or I can just ask one of my friends to display my name on the post box, so I can receive mails through that address?

No, you just need your friend to write a notarized document stating that you are residing at his/her residence.

That's what I did when my girlfriend (now wife) moved in with me officially.

Just keep in mind that you're asking for a residence permit when you don't really reside here, and they know you haven't resided here before. So if you and your friend sign official documents saying you are residing here, and they find out you're not, that could be trouble. And yes, we know firsthand that some officials take the time to come around and see if you are where you say you are.

Is this really illegal? I mean I pay full taxis here anyway, and I can stay at that place when I'm in Switzerland. Although I only spend around 2 months here in a year. If it's illegal it doesn't worths the effort. I don't really gain any advantage with this, except I don't have to renew the 120 days visa every year.

I am not sure if it would be illegal. I just know how the Swiss like to have everything fit into neat categories. To me, getting a residence permit implies you reside here more than just a few months of the year. Whether or not you pay taxes full-year is unrelated to how long you reside here. I think the Swiss authorities would agree.

But hey, why not do some more research on your idea? Just go in with your eyes open that they might not approve. I am sorry I don't know where you'd start. Just wanted to advise you to be careful. Good luck.

Re: Residency requirements for B permit

It would be illegal, to claim to be resident & no intention to spend at least 6 months here a year. Ever heard of the term Fraud?

This is a great idea! When I read about the visas, I excluded G, I thought that you have to live near the border. Now I had a closer look, and this requirement was lifted, you can live anywhere you want. This is exactly what I was looking for. Thank you!

You're welcome. That's why I'm here. You still need to tell me where you live so I can send the invoice. :P

Re: Residency requirements for B permit

B permit is a resident permit. In order to apply for, be in possession of / keep this this permit you must have the intention to become or be a resident of Switzerland. That means min. 183 days per kalendar year.

Out of curiousity: why do you pay taxes in CH if you don't live here?
