B permit renewal after permit has expired

Hi,

I am a Bulgarian citizen who began studying for a Masters at EPFL in October 2006. I completed my first two semesters, but during my third semester (September 2007 until January 2008) I am doing an internship in India. I am still considered officially enrolled at EPFL during this period, and will be returning to Lausanne beginning of February to continue my studies (two semesters left). The problem is my B permit expired in October 2007. Before I left I talked to the Crissier commune office de la population (since I lived in Crissier) and asked them what to do. The woman there told me it's ok, that she can keep my permit and when I come back she can renew it without me having to have a new visa,etc. Relieved, I set off for India. However, now I am returning and my boyfriend called her to make sure everything is still ok (his French is much better than mine ) and now she is saying that she is not sure the permit can get renewed, it is up to the canton, etc.

I tried looking for similar threads but did not find anything; sorry if I am re-posting.

So, the situation is a bit tricky because:
1. Bulgaria is now in the EU (since Jan 2007) but was not when I first arrived in Switzerland
2. Renewing my permit after it has been expired for 3 months may be more complicated than if I had renewed it in time.

Does anyone know what I can do when I return? What documents will I need to renew my permit? Will they ask me to get a new visa??

1. Bulgaria is not in the EU as far as the Swiss are concerned!
2. Yes this is a fact unless...

When you went to your commune did you get anything back in writing from the woman there or was this only a conversation. What I am saying is you have acted exactly correctly and she should have noted this. In this case you will have no problem with a renewal. I guess though she never realised that your permit was expiring and never informed the authorities to freeze it. And now she will deny every saying that it would be no problem.

Now you will need to reapply for the permit and I suggest quickly and with a letter of explanation preferably backed up by the woman at the commune.

My situation was not quite the same as yours but as I first applied for my permit to study here (I am not an EU member) my community told me what paperwork I would need. . . it ended up not being correct and taking a lawyer to sort out the mess.

My suggestion to you is to have your boyfriend call the Immigration Office for the Canton, explain what happened, and ask them what kind of paperwork you will need.

This should help you get your permit again.

Thanks for your reply. Some people are helping me to talk to this woman from Crissier and other people to establish how to resolve the situation. Unfortunately I did not get a written note from the woman before I left (I should have done that).

I am just wondering whether when I reapply for my permit the authorities will request a new visa. This is exactly what I was trying to avoid when I left Switzerland, because when I got my first visa it took a few months and many documents were required. If this needs to be done again, I am not sure I will be able to continue with the upcoming semester. If I do need to reapply for a visa, do you know if it's possible that I continue with my classes at EPFL during the visa application process? Can I apply for a visa from Switzerland itself?

I guess the lesson learned is not to trust an official who promises you things will be ok, and to always get written confirmations of important exchanges.

@Darkphoenix: yes, that is what I am going to do, in fact someone employed by EPFL is also helping to talk to the immigration authorities directly (instead of through the commune de Crissier) to exactly establish what can be done, what documents are needed, etc.

My advice to other people with unusual situations -- don't trust what the people at the commune office say, or if you do, always get a written confirmation of what they have told you to do. It seems that their advice is sometimes incorrect with respect to the actual immigration laws.

I will post back what I end up doing for future reference.
