L regular work permit to Student permit

Dear All,

Thanks for reading my question. I will keep it short

I'm currently doing an internship with L permit for Praktikants which is not extendable for more than a year. That expires in next year March.

I also applied for a masters programme, which I have to start in next september if I get selected.

Now I have a six months gap between two incidents (end of my internship and start of my masters). If I go back to my country, getting student visa becomes little complex as I have to show huge amount of money in my bank account.

What are the options Do I have ? Would it be possible to request my employee to apply a regular L work permit for me and then convert it to a student permit in september if I get selected to Masters ? Is this legally possible ?

Could you people suggest any other options for my situation ?

Without knowing your nationality it's a bit difficult, but I guess from your comments that you're probably non-EU. In which case the answer is probably no, your employer wouldn't be able to change your L permit and if he could you probably wouldn't be allowed to switch over to a student one as you would still need to prove you have sufficient funds to support yourself while studying. You're only allowed to work 15 hours a week as a student.

Also don't forget that as a non-EU your employer would have to show that they can't find a Swiss or EU national to do that job. So while they can employ you as an intern now it may be a totally different story trying to change you to a regular employee. There would be a lot of costs involved on their part for advertising the position for several months, application to the authorities for your permit status change, etc.

I don't think keeping a permit will get you out of having to prove that you have enough money for the student permit.

If you want to remain here though, how about asking if you can extend your internship for a while?

Thanks a lot for the answers.

Yes, I'm from a NonEU country.
Secondly, company already showed some positive signs about tasking me in as a regular employee. I know this is a very complex process for the company. But Still I can make that request to them.

My main question was, to which Medea Fleecestealer has provided an answer saying 'NO', whether it will be possible to switch to student permit from L work permit. Isn't it possible if the company employees me for 15 hours during my masters ?

Unfortunately extending internship is not an option. Praktikants are given a special L permit which is not extendable for more than a year.

On the other hand, working full time for six months, will allow me to save good amount of money for my masters.

You can get a permit based on a full time job... but your company would have to prove that they couldn't find someone from the EU/CH to do it first.

As far as keeping that permit whilst you are studying, the powers that be won't give you a work permit based on 15 hours a week, as that is not enough to support yourself. You would need a full time contract I would think, then you could study part time alongside your job I guess.

Or

You can get a student permit, study full time, and work 15 hours a week as allowed on the student permit.

Thanks for your support guys.

Well, I can only apply for a student permit once I hear back from the university. That only happens in March and March being the end of internship duration, I don't think that will give enough time to process my application.

I will anyway run this through my employee and ask whether it will be possible to get the L work permit for 1 year and then convert it to student permit after 6 months in case I get in to the masters. Being able to work part time for 15 hours and also I would be able to have good amount of money in my Bank as a result of some hard savings in the working six months might help me to convince authorities I have enough source to live as a student.

Anyway as I understood from your helpful comments, most of it depends on how the company approaches my situation.

I will share my experience later so it might help anyone else who will be in a similar situation.
